AMENDMENT TO HOUSE BILL 3081

2    AMENDMENT NO. ______. Amend House Bill 3081 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by adding Section
522-105 as follows:
 
6    (105 ILCS 5/22-105 new)
7    Sec. 22-105. Out-of-school time programs.
8    (a) The General Assembly declares that it is the policy of
9this State to provide all young people between the ages of 6
10and 19 with access to quality out-of-school time programs
11through a State commitment to sufficient and sustainable
12funding for programs that promote positive youth development.
13Further, this State is a national leader in the community
14schools model, which helps strengthen out-of-school time
15programs through school and community partnerships in order to
16meet the whole needs of all children and youth. The need for

1this policy is based on the following legislative findings:
2        (1) The General Assembly finds that youth who are
3    engaged in quality out-of-school time programs and
4    community schools are more likely to succeed in academics,
5    employment, and civic affairs than youth who do not
6    participate in those programs. Youth with high levels of
7    participation in quality out-of-school time programs miss
8    fewer days of school, have lower drop-out rates, and
9    higher rates of graduation. Further, juvenile crime peaks
10    in the after-school hours and out-of-school time programs
11    help prevent crime victimization and help youth make
12    healthy choices.
13        (2) The General Assembly also finds that youth in this
14    State face greater barriers to accessing out-of-school
15    time programs than ever before:
16            (A) Demand for out-of-school time programs far
17        outpaces the supply of those programs.
18            (B) Funding is fragmented among State agencies.
19            (C) The path to accessing public funding is often
20        difficult.
21            (D) Funding inconsistencies make it difficult for
22        out-of-school time programs to maintain a qualified
23        workforce.
24        (3) The General Assembly also finds that the State,
25    having demonstrated national leadership in advancing youth
26    development, must also expand out-of-school time

1    programming in order to realize the full, continued
2    benefits of public investment in this State's young
3    people.
4    (b) As used in this Section:
5    "Community school" means a public school that works with
6the community to improve student outcomes and addresses the
7needs of the whole child; that is unique and responsive to its
8community; and that includes integrated student support,
9expanded learning opportunities, family engagement, and
10collaborative leadership.
11    "Out-of-school time programs" means positive youth
12development activities provided to youth between the ages of 6
13and 19 during the hours before or after school, during the
14school year and summer recess from school, or during the
15weekends, including, but not limited to, programs that provide
16any one or more of the following: academic support; arts,
17music, sports, cultural enrichment, and other recreation;
18health promotion and diseases prevention; life skills and work
19and career development; and youth leadership development.
20    (c) The State Board of Education shall establish an
21Out-of-School Time Advisory Council for the purpose of
22providing information and advice to the Governor and State
23agencies regarding State and federal policy and funding issues
24affecting out-of-school time programs based on regular and
25systematic input from providers.
26        (1) The Out-of-School Time Advisory Council shall

1    include representation from both public and private
2    organizations and shall be composed of all of the
3    following members:
4            (A) Four members of the General Assembly: one
5        appointed by the President of the Senate; one
6        appointed by the Minority Leader of the Senate; one
7        appointed by the Speaker of the House of
8        Representatives; and one appointed by the Minority
9        Leader of the House of Representatives.
10            (B) One representative of the State Board of
11        Education, appointed by the State Superintendent of
12        Education.
13            (C) One representative of the Department of Human
14        Services, appointed by the Secretary of Human
15        Services.
16            (D) One representative of the Illinois Criminal
17        Justice Information Authority, appointed by the
18        Executive Director of the Illinois Criminal Justice
19        Information Authority.
20            (E) One representative of the Department of Early
21        Childhood, appointed by the Secretary of Early
22        Childhood.
23            (F) Three providers of out-of-school time programs
24        who are from various settings, appointed by the
25        Governor.
26            (G) One representative of a community-school

1        lead-partner agency, appointed by Governor.
2            (H) A private philanthropic funder, appointed by
3        Governor.
4            (I) A principal of a school that has out-of-school
5        time programs or employs the community-schools model,
6        appointed by Governor.
7            (J) A superintendent of a school district that has
8        out-of-school time programs or employs the
9        community-schools model, appointed by Governor.
10            (K) A researcher or evaluator of out-of-school
11        time programs, appointed by Governor.
12            (L) Additional public members that have an
13        interest in out-of-school time programs, including law
14        enforcement, business, and youth advocacy, appointed
15        by Governor.
16        The Out-of-School Time Advisory Council membership
17    shall be representative of the diversity of out-of-school
18    time programs regarding geography, size, and public or
19    nonpublic operation.
20        (2) The Governor shall designate one of the
21    Out-of-School Time Advisory Council members who is a
22    nongovernment stakeholder to serve as co-chairperson and
23    shall designate the representative of the State Board of
24    Education to serve as the other co-chairperson.
25        (3) The Out-of-School Time Advisory Council shall meet
26    no less than 4 times each year.

1    (d) The Out-of-School Time Advisory Council shall do all
2of the following:
3        (1) provide information on the status of any funding
4    provided for out-of-school time programs in each fiscal
5    year, including the number of applications received, the
6    number of applications funded, and the amount and timing
7    of committed funding;
8        (2) provide recommendations on any legislative or
9    administrative action needed to ensure that funding for
10    before-school and after-school programs is allocated
11    promptly to qualified providers of out-of-school time
12    programs;
13        (3) provide information on the quality of services and
14    accountability measures that are appropriate for
15    school-age children and youth;
16        (4) provide information regarding any challenges faced
17    by out-of-school time programs that impede the provision
18    of the best possible services;
19        (5) provide recommendations on the equitable reach of
20    out-of-school time programs to ensure that the State has
21    policies in place that promote access to the children and
22    youth most in need of services, including, but not limited
23    to, students of color, low-income communities, rural
24    communities, and other marginalized communities;
25        (6) make recommendations to the Governor and State
26    agencies on reporting requirements, priority points, a

1    statewide evaluation, and licensure for out-of-school time
2    programs; and
3        (7) create and deliver to the Governor and General
4    Assembly an annual report on statewide successes in
5    out-of-school time programs and areas of growth for the
6    future.".
