| 1 | | the Senate; |
| 2 | | (3) one member shall be appointed by the Minority |
| 3 | | Leader of the House of Representatives; |
| 4 | | (4) one member shall be appointed by the Minority |
| 5 | | Leader of the Senate; |
| 6 | | (5) one member shall be the Director of the Illinois |
| 7 | | Power Agency, or his or her designee; and |
| 8 | | (6) 6 members shall be appointed by the Governor. |
| 9 | | (c) The appointments made by the Governor shall include one |
| 10 | | member with legal expertise, one member with engineering |
| 11 | | expertise, one member with financial expertise, one member |
| 12 | | representing the employer community, one member representing |
| 13 | | production agriculture land owners, and one member |
| 14 | | representing the environmental community. |
| 15 | | (d) The Director may retain services from outside parties |
| 16 | | with legal, engineering, and financial expertise to assist the |
| 17 | | Commission in carrying out its duties. |
| 18 | | (e) The Illinois Power Agency may assist the Director in |
| 19 | | staffing and administering the Commission. |
| 20 | | (f) Commission members are not eligible to receive |
| 21 | | compensation or reimbursement of expenses.

| 22 | | Section 15. Report on carbon capture and sequestration |
| 23 | | legislation. |
| 24 | | (a) The Commission shall file a report no later than
|
| 25 | | December 31, 2012 with the General Assembly on all issues |

| 1 | | deemed appropriate to carbon capture and sequestration |
| 2 | | legislation, including, but not limited to, the following: |
| 3 | | (1) Ownership of the CO2. |
| 4 | | (2) Liability for release of CO2. |
| 5 | | (3) Acquisition and ownership of pore space. |
| 6 | | (4) Procedures and safeguards for the transportation |
| 7 | | and sequestration of CO2. |
| 8 | | (5) Methodology to establish any necessary fees,
|
| 9 | | costs, or offsets. |
| 10 | | (6) Potential use of CO2. |
| 11 | | (7) Construction of pipelines. |
| 12 | | (8) Coordination with federal and state laws and |
| 13 | | regulations. |
| 14 | | (9) Coordination with the Illinois Department of |
| 15 | | Natural Resources, the Illinois Environmental Protection |
| 16 | | Agency, the United States Environmental Protection Agency, |
| 17 | | and other applicable regulatory agencies and commissions. |
| 18 | | (b) The Commission shall be abolished upon filing its |
| 19 | | report with the General Assembly. |
| 20 | | Section 20. Repealer. This Act is repealed on January 1, |
| 21 | | 2013.

| 22 | | Section 99. Effective date. This Act takes effect upon |
| 23 | | becoming law.
