| 4 | | "Section 5. The Illinois Grant Funds Recovery Act is |
| 5 | | amended by adding Section 11.5 as follows:

| 7 | | Sec. 11.5. Contract performance metrics. |
| 8 | | (a) Consistent with the objectives of budgeting for |
| 9 | | outcomes, as soon as practicable after the effective date of |
| 10 | | this amendatory Act of the 98th General Assembly, each grantor |
| 11 | | agency, in coordination with the Governor's Office of |
| 12 | | Management and Budget, shall undertake a review of its |
| 13 | | contracts and grants to assess which contracts and grants, and |
| 14 | | categories thereof, are appropriate candidates for the |
| 15 | | implementation of a performance-based contract evaluation |
| 16 | | model. |

| 1 | | (b) Each grantor agency shall refine current performance |
| 2 | | metrics and develop new metrics for programs, including |
| 3 | | contracts and grants that fall within the categories determined |
| 4 | | to be appropriate by the Governor's Office of Management and |
| 5 | | Budget and the grantor agency under subsection (a) of this |
| 6 | | Section. Performance metrics may be based on required program |
| 7 | | components and a methodology that incorporates the reasonable |
| 8 | | costs of the required program components. |
| 9 | | (c) Beginning in State Fiscal Year 2016, each grantor |
| 10 | | agency shall ensure that service contracts and agreements, as |
| 11 | | deemed appropriate under subsection (a) of this Section, |
| 12 | | include performance reporting requirements. |
| 13 | | (d) Each grantor agency shall enhance its processes to |
| 14 | | monitor and address noncompliance with reporting requirements |
| 15 | | and with program performance standards. Where applicable, the |
| 16 | | process may include a corrective action plan. The monitoring |
| 17 | | process shall include a plan for tracking and documenting |
| 18 | | performance-based contracting decisions. |
| 19 | | (e) Notwithstanding any other provision of this Act, the |
| 20 | | provisions of this Section apply to all contracts and grants |
| 21 | | subject to this Act. |
| 22 | | (f) Nothing in this Section is applicable to grants |
| 23 | | authorized under the General Obligation Bond Act or the Build |
| 24 | | Illinois Bond Act.
