820 ILCS 115/3.5 new

     Amends the Illinois Wage Payment and Collection Act. Provides that employees must be given notice of the shifts to be worked 2 weeks in advance of the scheduled shift. Establishes requirements for minimum pay for working shifts outside of scheduled shifts.

1    AN ACT concerning employment.
  
 
2    Be it enacted by the People of the State of Illinois,
 
3represented in the General Assembly:
  
 
 
4    Section 5. The Illinois Wage Payment and Collection Act is 
5amended  by adding Section 3.5 as follows:
 
6    (820 ILCS 115/3.5 new)
7    Sec. 3.5. Worker's schedule; pay requirements.
8    (a) An employer shall provide an employee with notice of 
9the employee's shift schedule 2 weeks before the employee is 
10scheduled to work.
11    (b) An employer shall pay employees in accordance with the 
12following requirements:
13        (1) An employee who works a shift outside of the 
14    employee's scheduled work shift shall be paid the greater 
15    of 4 hours pay or the pay for the entire shift worked.
16        (2) An employee who presents for work for a regularly 
17    scheduled shift shall be paid the greater of the amount of 
18    pay equal to the pay for one-half of the duration of the 
19    scheduled shift or the amount of pay for the entire shift 
20    worked.
