1 AMENDMENT TO HOUSE BILL 44
2 AMENDMENT NO. . Amend House Bill 44 by replacing the
3 title with the following:
4 "AN ACT concerning child witnesses, amending named
5 Acts."; and
6 by replacing everything after the enacting clause with the
7 following:
8 "Section 5. The Code of Criminal Procedure of 1963 is
9 amended by adding Sections 106B-2, 112-9, and 115-20 as
10 follows:
11 (725 ILCS 5/106B-2 new)
12 Sec. 106B-2. Child advocate. A child under 18 years of
13 age who testifies under this Article shall be allowed to have
14 an advocate on his or her behalf. The child advocate may be
15 one of those persons permitted under subdivision (d)(5) of
16 Section 106B-5. The child advocate shall be appointed by the
17 court or assigned by the State's Attorney.

19 Sec. 112-9. Child advocate. A child under 18 years of
20 age who testifies before the Grand Jury shall be allowed to

1 have an advocate on his or her behalf. The child advocate may
2 be one of those persons permitted under subdivision (d)(5) of
3 Section 106B-5. The child advocate shall be appointed by the
4 court or assigned by the State's Attorney.

6 Sec. 115-20. Child advocate. A child under 18 years of
7 age who testifies before the court shall be allowed to have
8 an advocate on his or her behalf. The child advocate may be
9 one of those persons permitted under subdivision (d)(5) of
10 Section 106B-5. The child advocate shall be appointed by the
11 court or assigned by the State's Attorney.
12 Section 10. The Statewide Grand Jury Act is amended by
13 adding Section 11 as follows:
14 (725 ILCS 215/11 new)
15 Sec. 11. Child advocate. A child under 18 years of age
16 who testifies before the Statewide Grand Jury shall be
17 allowed to have an advocate on his or her behalf. The child
18 advocate may be one of those persons permitted under
19 subdivision (d)(5) of Section 106B-5 of the Code of Criminal
20 Procedure of 1963. The child advocate shall be appointed by
21 the court or assigned by the Attorney General or the State's
22 Attorney.
23 Section 99. Effective date. This Act takes effect upon
24 becoming law.".
