Amends the Children and Family Services Act. Provides
that shelter care shall include reception and diagnostic
centers for minors who are homeless or otherwise under the
custody or guardianship of the Department. Provides that the
Department shall ensure that a complete evaluation of the
minor is conducted to determine the least restrictive setting
that serves the minor's best interests. Provides that
residential facilities shall include campus-style settings
for minors who cannot be served in their own homes and whose
needs cannot be met by foster family home services or other
similar substitute care arrangements. Provides for the
authorization for the development and certification of
transitional housing placement program services. Effective
immediately.

1 AN ACT to amend the Children and Family Services Act by
2 changing Section 10 and adding Section 17a-13.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Children and Family Services Act is
6 amended by changing Section 10 and adding Section 17a-13 as
7 follows:

9 Sec. 10. Shelter care, group care, and residential
10 facilities. To establish and operate in the regions of the
11 State additional adequate shelter care, or group care, and
12 residential facilities. Shelter care shall include reception
13 and diagnostic centers for minors who are homeless or
14 otherwise under the custody or guardianship of the
15 Department. The Department shall ensure that a complete
16 evaluation of the minor is conducted to determine the least
17 restrictive setting that serves the minor's best interests
18 and that meets the minor's educational, treatment, and
19 security needs. Residential facilities shall include
20 campus-style settings for minors who cannot be served in
21 their own homes and whose needs cannot be met by foster
22 family home services or other similar substitute care
23 arrangements. Each facility shall provide a
24 multidisciplinary team to prepare and implement a transition
25 plan for the minor's move to another substitute care
26 placement.

29 Sec. 17a-13. Transitional housing placement program
30 services.

1 (a) The Department of Children and Family Services shall
2 develop programs to license private, nonprofit, or State
3 operated facilities to provide transitional housing placement
4 program services to persons who are at least 17 years old but
5 not more than 19 years old, who are in out-of-home placement
6 under the supervision of the Department, and who are
7 participating in an independent living program. Transitional
8 housing placement program services shall include the
9 following:
10 (1) Programs in which one or more of the
11 participants live in an apartment with an adult employee
12 of the licensee.
13 (2) Programs in which a participant lives
14 independently in an apartment rented or leased by the
15 licensee located in the building in which one or more
16 adult employees of the licensee reside and provide
17 supervision.
18 (3) Programs in which a participant lives
19 independently in an apartment rented or leased by a
20 licensee under the supervision of the licensee if the
21 Department approves.
22 (b) Certification. To be licensed an applicant shall
23 obtain certification from the Department that the facility
24 provides all of the following:
25 (1) Strict admission criteria for participants in
26 the program, including, but not limited to, consideration
27 of the applicant's age, previous placement history,
28 delinquency history, history of drug or alcohol abuse,
29 level of education, mental health history, medical
30 problems, and work experience. The Department shall
31 review the admission criteria to ensure that the criteria
32 are sufficient to protect participants and that they do
33 not discriminate on the basis of race, gender, sexual
34 orientation, or disability.

1 (2) Strict employment criteria that include a
2 consideration of the employee's age, drug or alcohol
3 history, and experience in working with persons in this
4 age group.
5 (3) A training program designed to educate
6 employees who work directly with participants about the
7 characteristics of persons in the age group placed in
8 long term care settings, and designed to ensure these
9 employees are able to adequately supervise and counsel
10 participants with training in independent living skills.
11 (4) A detailed plan for monitoring the placement of
12 persons under the licensee's care.
13 (5) A contract between the participating person and
14 the licensee that specifically sets out the requirements
15 of each party, and in which the licensee and the
16 participant agree to the requirements of this Section.
17 (6) An allowance to be provided to each participant
18 in the program. In the case of a participant living
19 independently, this allowance shall be sufficient for the
20 participant to purchase food and other necessities.
21 (7) A system for payment of utilities, telephone,
22 and rent.
23 (8) Policies regarding the following:
24 (A) Education requirements.
25 (B) Work expectations.
26 (C) Savings requirements.
27 (D) Personal safety.
28 (E) Visitors, including, but not limited to,
29 visitation by the placement auditor under item (4).
30 (F) Emergencies.
31 (G) Medical problems.
32 (H) Disciplinary measures.
33 (I) Child care.
34 (J) Pregnancy.

1 (K) Curfew.
2 (L) Apartment cleanliness.
3 (M) Use of utilities and phone.
4 (N) Budgeting.
5 (O) Care of furnishings.
6 (P) Decorating of apartments.
7 (Q) Cars.
8 (R) Lending or borrowing money.
9 (S) Unauthorized purchases.
10 (T) Dating.
11 (U) Grounds for termination that may include
12 illegal activities or harboring runaways.
13 (9) Apartment furnishings, and a policy on
14 disposition of the furnishings when the participant
15 completes the program.
16 (10) Evaluation of the participant's progress in
17 the program reporting to the independent living program
18 and to the Department regarding that progress.
19 (11) A linkage to the Federal Job Training and
20 Partnership Act program administering the local area to
21 provide employment training to eligible participants.
22 Section 99. Effective date. This Act takes effect upon
23 becoming law.
