Amends the Illinois Income Tax Act by creating a tax
checkoff for the American Diabetes Foundation Fund. Amends
the State Finance Act to create the Fund. Amends the
Department of Human Services Act to provide that the
Department shall provide grants to the American Diabetes
Foundation for diabetes research from appropriations to the
Department from the American Diabetes Foundation Fund.

1 AN ACT in relation to taxes, amending named Acts.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Department of Human Services Act is
5 amended by adding Section 10-12 as follows:
6 (20 ILCS 1305/10-12 new)
7 Sec. 10-12. Grants to the American Diabetes Foundation.
8 The Department of Human Services shall make grants to the
9 American Diabetes Foundation for research on diabetes from
10 appropriations to the Department from the American Diabetes
11 Fund, a special fund created in the State Treasury.
12 Section 10. The State Finance Act is amended by adding
13 Section 5.449 as follows:

15 Sec. 5.449. The American Diabetes Foundation Fund.
16 Section 15. The Illinois Income Tax Act is amended by
17 changing Sections 509 and 510 and adding Section 507R as
18 follows:

20 Sec. 507R. The American Diabetes Foundation check off.
21 The Department shall print on its standard individual income
22 tax form a provision indicating that if the taxpayer wishes
23 to contribute to the American Diabetes Foundation Fund, as
24 authorized by this amendatory Act of 1997, he or she may do
25 so be stating the amount of the contribution (not less than
26 $1) on the return and that the contribution will reduce the
27 taxpayer's refund or increase the amount of payment to

1 accompany the return. Failure to remit any amount of
2 increased payment shall reduce the contribution accordingly.
3 This Section shall not apply to any amended return.

5 Sec. 509. Tax checkoff explanations. All individual
6 income tax return forms shall contain appropriate
7 explanations and spaces to enable the taxpayers to designate
8 contributions to the Child Abuse Prevention Fund, to the
9 Community Health Center Care Fund, to the Illinois Wildlife
10 Preservation Fund as required by the Illinois Non-Game
11 Wildlife Protection Act, to the Alzheimer's Disease Research
12 Fund as required by the Alzheimer's Disease Research Act, to
13 the Assistance to the Homeless Fund as required by this Act,
14 to the Heritage Preservation Fund as required by the Heritage
15 Preservation Act, to the Child Care Expansion Program Fund as
16 required by the Child Care Expansion Program Act, to the Ryan
17 White AIDS Victims Assistance Fund, to the Assistive
18 Technology for Persons with Disabilities Fund, to the
19 Domestic Violence Shelter and Service Fund, to the United
20 States Olympians Assistance Fund, to the Youth Drug Abuse
21 Prevention Fund, to the Persian Gulf Conflict Veterans Fund,
22 to the Literacy Advancement Fund, to the Ryan White Pediatric
23 and Adult AIDS Fund, to the Illinois Special Olympics
24 Checkoff Fund, to the Breast and Cervical Cancer Research
25 Fund, to the Korean War Memorial Fund, to the Heart Disease
26 Treatment and Prevention Fund, to the Hemophilia Treatment
27 Fund, to the American Diabetes Foundation Fund, to the Women
28 in Military Service Memorial Fund, and to the Meals on Wheels
29 Fund. Each form shall contain a statement that the
30 contributions will reduce the taxpayer's refund or increase
31 the amount of payment to accompany the return. Failure to
32 remit any amount of increased payment shall reduce the
33 contribution accordingly.

1 If, on October 1 of any year, the total contributions to
2 any one of the funds made under this Section do not equal
3 $100,000 or more, the explanations and spaces for designating
4 contributions to the fund shall be removed from the
5 individual income tax return forms for the following and all
6 subsequent years and all subsequent contributions to the fund
7 shall be refunded to the taxpayer.

12 Sec. 510. Determination of amounts contributed. The
13 Department shall determine the total amount contributed to
14 each of the following: the Child Abuse Prevention Fund, the
15 Illinois Wildlife Preservation Fund, the Community Health
16 Center Care Fund, the Assistance to the Homeless Fund, the
17 Alzheimer's Disease Research Fund, the Heritage Preservation
18 Fund, the Child Care Expansion Program Fund, the Ryan White
19 AIDS Victims Assistance Fund, the Assistive Technology for
20 Persons with Disabilities Fund, the Domestic Violence Shelter
21 and Service Fund, the United States Olympians Assistance
22 Fund, the Youth Drug Abuse Prevention Fund, the Persian Gulf
23 Conflict Veterans Fund, the Literacy Advancement Fund, the
24 Ryan White Pediatric and Adult AIDS Fund, the Illinois
25 Special Olympics Checkoff Fund, the Breast and Cervical
26 Cancer Research Fund, the Korean War Memorial Fund, the Heart
27 Disease Treatment and Prevention Fund, the Hemophilia
28 Treatment Fund, the American Diabetes Foundation Fund, the
29 Women in Military Service Memorial Fund, and the Meals on
30 Wheels Fund; and shall notify the State Comptroller and the
31 State Treasurer of the amounts to be transferred from the
32 General Revenue Fund to each fund, and upon receipt of such
33 notification the State Treasurer and Comptroller shall

5 Section 99. Effective date. This Act takes effect upon
