Amends the Environmental Health Practitioner Licensing
Act. Specifically exempts veterinarians under the Act.

1 AN ACT to amend the Environmental Health Practitioner
2 Licensing Act by changing Sections 5 and 16.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Environmental Health Practitioner
6 Licensing Act is amended by changing Sections 5 and 16 as
7 follows:

9 Sec. 5. Legislative intent. In adopting this Act, it is
10 recognized that the field of environmental health is a
11 dynamic field that is continually evolving into new and
12 complex areas of concern. It is the legislative intent of
13 this Act to recognize the occasional existence of overlapping
14 functions with engineers, industrial hygienists,
15 veterinarians, and other professions licensed to carry out
16 specific activities that may touch on some aspects of the
17 field of environmental health. It is not the intent of this
18 Act to require registration of these individuals, nor is it
19 the intent that the registration of any person under this Act
20 would allow that person to perform functions or engage in
21 activities that would include the practice of engineering.
22 It is the sole purpose and intent of this Act to safeguard
23 the health, safety, and general welfare of the public from
24 adverse environmental factors and to license those
25 environmental health professionals who have completed
26 approved environmental health or science curricula, are
27 qualified to work in the field of environmental health,
28 within the scope of practice as defined in this Act, and not
29 to restrict nor interfere with interstate commerce.

2 Sec. 16. Exemptions. This Act does not prohibit or
3 restrict any of the following:
4 (1) A person performing the functions and duties of an
5 environmental health practitioner under the direct
6 supervision of a licensed environmental health practitioner
7 or licensed professional engineer if that person is not
8 responsible for the administration or supervision of one or
9 more employees engaged in an environmental health program.
10 (2) A person licensed in this State under any other Act
11 from engaging in the practice for which he or she is licensed
12 including, but not limited to, a veterinarian licensed under
13 the Veterinary Medicine and Surgery Practice Act of 1994
14 engaging in the practice of veterinary medicine or veterinary
15 surgery.
16 (3) A person working in laboratories licensed by,
17 registered with, or operated by the State of Illinois.
18 (4) A person employed by a State-licensed health care
19 facility who engages in the practice of environmental health
20 or whose job responsibilities include ensuring that the
21 environment in the health care facility is healthy and safe
22 for employees, patients, and visitors.

24 Section 99. Effective date. This Act takes effect upon
25 becoming law.
