1 AMENDMENT TO HOUSE BILL 174
2 AMENDMENT NO. . Amend House Bill 174, AS AMENDED, by
3 replacing the title with the following:
4 "AN ACT in relation to money."; and
5 by inserting, immediately above Section 999, the following:
6 "Section 870. The Illinois Marriage and Dissolution of
7 Marriage Act is amended by adding Sections 714 and 715 as
8 follows:
9 (750 ILCS 5/714 new)
10 Sec. 714. Willful default on support; penalties. A
11 person who willfully defaults on an order for child support
12 issued by an Illinois court or authorized administrative
13 proceeding may be subject to summary criminal contempt
14 proceedings.
15 In addition to other remedies provided by law regarding
16 the suspension of professional and occupational licenses,
17 recreational licenses, and driver's licenses, the State
18 licensing agency shall have the authority to withhold or
19 suspend, or to restrict the use of driver's licenses,
20 professional and occupational licenses or certificates, and
21 recreational licenses of individuals owing overdue support or

1 failing, after receiving appropriate notice, to comply with
2 subpoenas or warrants relating to paternity or child support
3 proceedings. The suspension shall remain in effect until all
4 defaults on an order for child support are satisfied.
5 This Section applies to an order for child support issued
6 under the Illinois Public Aid Code, the Illinois Marriage and
7 Dissolution of Marriage Act, the Illinois Parentage Act of
8 1984, the Revised Uniform Reciprocal Enforcement of Support
9 Act, and the Uniform Interstate Family Support Act.

11 Sec. 715. Information to locate support obligors and
12 putative fathers. The Illinois Department of Public Aid's
13 Child and Spouse Support Unit, the State's attorney, or any
14 other appropriate State official may request and shall
15 receive from employers, labor unions, telephone companies,
16 and utility companies location information concerning
17 putative fathers and noncustodial parents for the purpose of
18 establishing a child's paternity or establishing, enforcing,
19 or modifying a child support obligation. In this Section,
20 "location information" means information about (i) the
21 physical whereabouts of a putative father or noncustodial
22 parent, (ii) the putative father or noncustodial parent's
23 employer, or (iii) the salary, wages, and other compensation
24 paid and the health insurance coverage provided to the
25 putative father or noncustodial parent by the putative father
26 or noncustodial parent or by a labor union of which the
27 putative father or noncustodial parent is a member.".
