1 AMENDMENT TO HOUSE BILL 447
2 AMENDMENT NO. . Amend House Bill 447 on page 1,
3 lines 2 and 6 by changing "Section 9A-9" each time it appears
4 to "Sections 6-1.2 and 9A-9"; and
5 on page 1, by inserting after line 6 the following:
6 "(305 ILCS 5/6-1.2) (from Ch. 23, par. 6-1.2)
7 Sec. 6-1.2. Need. Income available to the person, when
8 added to contributions in money, substance, or services from
9 other sources, including contributions from legally
10 responsible relatives, must be insufficient to equal the
11 grant amount established by Department regulation (or by
12 local governmental unit in units which do not receive State
13 funds) for such a person.
14 In determining income to be taken into account:
15 (1) The first $75 of earned income in income
16 assistance units comprised exclusively of one adult
17 person shall be disregarded, and for not more than 3
18 months in any 12 consecutive months that portion of
19 earned income beyond the first $75 that is the difference
20 between the standard of assistance and the grant amount,
21 shall be disregarded.
22 (2) For income assistance units not comprised

1 exclusively of one adult person, when authorized by rules
2 and regulations of the Illinois Department, a portion of
3 earned income, not to exceed the first $25 a month plus
4 50% of the next $75, may be disregarded for the purpose
5 of stimulating and aiding rehabilitative effort and
6 self-support activity.
7 "Earned income" means money earned in self-employment or
8 wages, salary, or commission for personal services performed
9 as an employee. The eligibility of any applicant for or
10 recipient of public aid under this Article is not affected by
11 the payment of any grant under the "Senior Citizens and
12 Disabled Persons Property Tax Relief and Pharmaceutical
13 Assistance Act" or any refund or payment of the federal
14 Earned Income Tax Credit.
15 If federal laws or regulations applicable to persons
16 receiving assistance under Articles III or IV of this Code
17 permit or require the exemption of earned income in excess of
18 the foregoing limitation on earned income exemptions or
19 permit or require the exemption of certain other income and
20 resources, the Illinois Department, may, by rule, authorize
21 comparable exemptions in determining need under this Section.
