105 ILCS 5/14-7.02a from Ch. 122, par. 14-7.02a
Amends the School Code. Increases to $2,500 from $2,000
the maximum per capita tuition charge reimbursement when a
school district's cost of educating a child requiring
extraordinary special education services and facilities is in
excess of one and one-half times the district's per capita
tuition charge for the prior year. Effective immediately.

1 AN ACT to amend the School Code by changing Section
2 14-7.02a.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The School Code is amended by changing
6 Section 14-7.02a as follows:
7 (105 ILCS 5/14-7.02a) (from Ch. 122, par. 14-7.02a)
8 Sec. 14-7.02a. Children requiring extraordinary special
9 education services and facilities. A school district
10 providing for a child requiring extraordinary special
11 education services because of the nature of his disability is
12 eligible for reimbursement from the State if the cost of
13 educating that child is computed, as set forth in Section
14 14-7.01, to be in excess of one and one-half times the
15 district per capita tuition charge for the prior year. Such
16 costs beyond one per capita tuition charge shall be
17 reimbursed, up to a maximum of $2,500 $2,000.
18 A child is deemed to require extraordinary special
19 education services and facilities under the following
20 conditions:
21 1) the school district has determined that the
22 child requires extraordinary special education facilities
23 pursuant to the multidisciplinary case study and the
24 individualized education program;
25 2) the school district maintains adequate cost
26 accounting to document the per capita cost of special
27 education; and
28 3) the school district submits approval and claim
29 data annually for each eligible child.
30 Extraordinary special education services provided on a
31 one-half day basis shall only be reimbursed at a rate of

1 one-half the amount otherwise provided herein.

3 Section 99. Effective date. This Act takes effect upon
4 becoming law.
