1 AMENDMENT TO HOUSE BILL 767
2 AMENDMENT NO. . Amend House Bill 767, AS AMENDED,
3 with reference to page and line numbers of House Amendment
4 No. 1, on page 4, in line 28, by replacing "obtained" with
5 "granted"; and
6 on page 4, by replacing line 31 with the following:
7 "Agency for, and the Agency may grant, a development or
8 construction permit for the facility for which local siting
9 approval was granted"; and
10 on page 4, in line 32, by deleting "facility"; and
11 on page 4, in line 34, before "the Agency shall conduct", by
12 inserting the following:
13 "the permit applicant shall cause written notice of the
14 permit application to be served upon the appropriate county
15 board or governing body of the municipality that granted
16 siting approval for that facility and upon any party to the
17 siting proceeding pursuant to which siting approval was
18 granted. In that event,"; and
19 on page 11, by replacing lines 8 through 12 with the
20 following:
21 "(i) Before issuing any RCRA permit or any permit for a
22 waste storage site, sanitary landfill, waste disposal site,

1 waste transfer station, waste treatment facility, or waste
2 incinerator the conduct of any waste-transportation or
3 waste-disposal operation, the Agency shall conduct an
4 evaluation of the prospective owner's or operator's prior
5 experience in waste management operations. The Agency"; and
6 on page 11, in lines 13 and 14, by replacing "prospective
7 operator", each time it appears, with "prospective owner or
8 operator"; and
9 on page 11, in line 18, by replacing "refuse disposal" with
10 "waste management refuse disposal"; and
11 on page 11, in line 24, by replacing "any hazardous waste"
12 with "any hazardous waste".
