Amends the Public Building Commission Act. Provides that
a public building commission which has not issued any bonds,
has no indebtedness, and has no operational leases (now has
not issued any bonds and has no indebtedness) may be
dissolved. Effective immediately.

1 AN ACT to amend the Public Building Commission Act by
2 changing Section 22.1.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Public Building Commission Act is
6 amended by changing Section 22.1 as follows:
7 (50 ILCS 20/22.1) (from Ch. 85, par. 1052.1)
8 Sec. 22.1. (a) Any Public Building Commission which has
9 not issued any bonds, and has no indebtedness, and has no
10 operational leases may be dissolved upon the filing, by the
11 presiding officer of the municipality, county seat or county
12 board which organized such Commission, in the office of the
13 recorder a copy of a resolution adopted by the governing body
14 of such municipality, county seat or county board approving
15 such dissolution.
16 (b) Any Public Building Commission which has fulfilled
17 the purpose for which it was created, and all bonds issued by
18 it and all of its contractual obligations except personnel
19 contracts have been paid, may be dissolved, upon the filing
20 by the presiding officer of the municipality, county seat or
21 county board which organized such Commission, in the office
22 of the recorder, a copy of a resolution adopted by the
23 governing body of such municipality, county seat or county
24 board approving such dissolution. Upon the dissolution of
25 such Commission pursuant to this subsection, the Treasurer of
26 the Commission shall cause all remaining funds under his
27 control to be transferred to the Treasurer of the
28 municipality, county seat or county which organized the
29 Commission.

1 Section 99. Effective date. This Act takes effect upon
2 becoming law.
