Amends the Consumer Fraud and Deceptive Business
Practices Act. Provides that an Internet service provider
must give each of its customers in this State a
pre-addressed, postage-paid postcard that the customer may
use to cancel service by U.S. Postal Service mail. Provides
that an Internet service provider who violates any of these
provisions commits an unlawful practice within the meaning of
the Act. Effective immediately.

1 AN ACT to amend the Consumer Fraud and Deceptive Business
2 Practices Act by adding Section 2EE.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Consumer Fraud and Deceptive Business
6 Practices Act is amended by adding Section 2EE as follows:

8 Sec. 2EE. Internet service providers. An Internet
9 service provider must give each of its customers in this
10 State a pre-addressed, postage-paid postcard that the
11 customer may use to cancel service by U.S. Postal Service
12 mail. The Internet service provider must provide the
13 postcard to the customer within 10 days after the account is
14 opened (or, in the case of an existing customer, within 30
15 days after the effective date of this amendatory Act of
16 1997). An Internet service provider who violates any
17 provision of this Section commits an unlawful practice within
18 the meaning of this Act.
19 As used in this Section, "Internet service provider"
20 means a person who provides to a customer, for a fee or
21 charge, access (regardless of whether the access is through
22 an online service that provides other services that are not
23 part of the Internet) on an ongoing basis to Internet
24 electronic mail, the World Wide Web, Internet file transfers,
25 or any other information or data that may be sent or received
26 through the Internet.
27 Section 99. This Act takes effect upon becoming law.
