1 AMENDMENT TO HOUSE BILL 916
2 AMENDMENT NO. . Amend House Bill 916, by replacing
3 the title with the following:
4 "AN ACT to amend the Firearm Owners Identification Card
5 Act by changing Section 1.1."; and
6 by replacing everything after the enacting clause with the
7 following:
8 "Section 5. The Firearm Owners Identification Card Act
9 is amended by changing Section 1.1 as follows:
10 (430 ILCS 65/1.1) (from Ch. 38, par. 83-1.1)
11 Sec. 1.1. For purposes of this Act:
12 "Counterfeit" means to copy or imitate, without legal
13 authority, with intent to deceive.
14 "Firearm" means any device, by whatever name known, which
15 is designed to expel a projectile or projectiles by the
16 action of an explosion, expansion of gas or escape of gas;
17 excluding, however:
18 (1) any pneumatic gun, spring gun, paint ball gun
19 or B-B gun which either expels a single globular
20 projectile not exceeding .18 inch in diameter and which
21 has a maximum muzzle velocity of less than 700 feet per

1 second or breakable paint balls containing washable
2 marking colors;
3 (2) any device used exclusively for signalling or
4 safety and required or recommended by the United States
5 Coast Guard or the Interstate Commerce Commission; or
6 (3) any device used exclusively for the firing of
7 stud cartridges, explosive rivets or similar industrial
8 ammunition;
9 (4) an antique firearm (other than a machine-gun)
10 which, although designed as a weapon, the Department of
11 State Police finds by reason of the date of its
12 manufacture, value, design, and other characteristics is
13 primarily a collector's item and is not likely to be used
14 as a weapon.
15 "Firearm Ammunition" means any self-contained cartridge
16 or shotgun shell, by whatever name known, which is designed
17 to be used or adaptable to use in a firearm; excluding,
18 however:
19 (1) any ammunition exclusively designed for use
20 with a device used exclusively for signalling or safety
21 and required or recommended by the United States Coast
22 Guard or the Interstate Commerce Commission; or
23 (2) any ammunition designed exclusively for use
24 with a stud or rivet driver or other similar industrial
25 ammunition.
26 "Transfer" means the actual, constructive or attempted
27 transfer of a firearm or firearm ammunition, with or without
28 consideration, whether or not there is an agency
29 relationship.
