1 AMENDMENT TO HOUSE BILL 974
2 AMENDMENT NO. . Amend House Bill 974, AS AMENDED, by
3 replacing the title with the following:
4 "AN ACT to amend the Critical Health Problems and
5 Comprehensive Health Education Act by changing Section 3.";
6 and
7 by replacing everything after the enacting clause with the
8 following:
9 "Section 5. The Critical Health Problems and
10 Comprehensive Health Education Act is amended by changing
11 Section 3 as follows.
12 (105 ILCS 110/3) (from Ch. 122, par. 863)
13 Sec. 3. Comprehensive Health Education Program. The
14 program established under this Act shall include, but not be
15 limited to, the following major educational areas as a basis
16 for curricula in all elementary and secondary schools in this
17 State: human ecology and health, human growth and
18 development, the emotional, psychological, physiological,
19 hygienic and social responsibilities of family life,
20 including sexual abstinence until marriage, prevention and
21 control of disease, including instruction in grades 6 through

1 12 on the prevention, transmission and spread of AIDS, public
2 and environmental health, consumer health, safety education
3 and disaster survival, mental health and illness, personal
4 health habits, alcohol, drug use, and abuse including the
5 medical and legal ramifications of alcohol, drug, and tobacco
6 use, abuse during pregnancy, sexual abstinence until
7 marriage, tobacco, nutrition, and dental health.
8 Curricula developed under programs established in
9 accordance with this Act in the major educational area of
10 safety education and disaster survival shall include
11 instruction and applied training in grades kindergarten
12 through 8 in basic first aid and cardiopulmonary
13 resuscitation. The State Board of Education shall develop and
14 make available to all elementary schools in this State
15 instructional materials and guidelines that will assist those
16 schools in incorporating the required instruction and
17 training into their existing curricula. In addition, schools
18 may arrange for the applied training in basic first aid and
19 cardiopulmonary resuscitation to be provided on a volunteer
20 basis by local police and firefighter departments, emergency
21 medical services agencies, and related service organizations
22 such as the American Red Cross and Save-a-Life Foundation.
23 First aid (including but not limited to cardiopulmonary
24 resuscitation and the Heimlich maneuver) may also be included
25 as a basis for curricula in all secondary schools in this
26 State.
27 Notwithstanding the above educational areas, the
28 following areas may also be included as a basis for curricula
29 in all elementary and secondary schools in this State: basic
30 first aid (including, but not limited to, cardiopulmonary
31 resuscitation and the Heimlich maneuver), early prevention
32 and detection of cancer, heart disease, diabetes, stroke, and
33 the prevention of child abuse, neglect, and suicide.
34 However, no pupil shall be required to take or

1 participate in any class or course on AIDS or family life
2 instruction if his parent or guardian submits written
3 objection thereto, and refusal to take or participate in the
4 course or program shall not be reason for suspension or
5 expulsion of the pupil.
6 Curricula developed under programs established in
7 accordance with this Act in the major educational area of
8 alcohol and drug use and abuse shall include classroom
9 instruction in grades 5 through 12. The instruction, which
10 shall include matters relating to both the physical and legal
11 effects and ramifications of drug and substance abuse, shall
12 be integrated into existing curricula; and the State Board of
13 Education shall develop and make available to all elementary
14 and secondary schools in this State instructional materials
15 and guidelines which will assist the schools in incorporating
16 the instruction into their existing curricula. In addition,
17 school districts may offer, as part of existing curricula
18 during the school day or as part of an after school program,
19 support services and instruction for pupils or pupils whose
20 parent, parents, or guardians are chemically dependent.

22 Section 99. Effective date. This Act takes effect upon
