Amends the Special Service Area Tax Law in the Property
Tax Code. Provides that if at least 30% of the roads in a
municipality are not owned or controlled by the municipality
and those roads provide access to emergency vehicles, then
the municipality may propose a special service area for
repair, maintenance, and reconstruction of those private
roads. Effective immediately.

1 AN ACT to amend the Property Tax Code by adding Section
2 27-90.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Property Tax Code is amended by adding
6 Section 27-90 as follows:
7 (35 ILCS 200/27-90 new)
8 Sec. 27-90. Special service area for privately owned or
9 maintained roads. If at least 30% of the street or road
10 mileage within the corporate limits of a municipality is
11 comprised of streets and roadways not owned or controlled by
12 the municipality or any other unit of government, and if the
13 streets and roadways (including related drainage facilities
14 and appurtenances) provide access for police, fire, and other
15 emergency vehicles, the municipality may propose a special
16 service area as provided in this Law for the purpose of
17 repairing, reconstructing, or maintaining those streets and
18 roadways; provided that if the owners of 51% or more in
19 number of the lots, tracts, and parcels of real estate that
20 are to be subject to the tax file a petition with the clerk
21 of the municipality agreeing with the establishment of a
22 special service area, then the corporate authorities of the
23 municipality shall proceed with the establishment of a
24 special service area. If a petition is not filed or contains
25 an insufficient number of signatures, the corporate
26 authorities of the municipality shall proceed no further and
27 the same establishment of a special service area shall not
28 again be initiated for a period of one year.
29 Section 99. Effective date. This Act takes effect upon
30 becoming law.
