1 AMENDMENT TO HOUSE BILL 1074
2 AMENDMENT NO. . Amend House Bill 1074 by replacing
3 the title with:
4 "AN ACT concerning government officials, amending named
5 Acts."; and
6 by replacing everything after the enacting clause with the
7 following:
8 "Section 5. The Illinois Governmental Ethics Act is
9 amended by changing Sections 2-110 and 3-101 as follows:
10 (5 ILCS 420/2-110)
11 Sec. 2-110. Honoraria.
12 (a) No official as defined in Section 2 of the Lobbyist
13 Registration Act member of the General Assembly shall accept
14 any honorarium.
15 (b) As used in this Section:
16 "Honorarium" means a payment of money or other item of
17 more than nominal value to an official as defined in Section
18 2 of the Lobbyist Registration Act to a member of the General
19 Assembly for an appearance or speech, excluding any actual
20 and necessary travel expenses incurred by the person member
21 of the General Assembly (and one relative) to the extent that

1 those expenses are paid by any other person. "Honorarium"
2 does not include (i) cash payments made on behalf of the
3 person a member of the General Assembly to an organization
4 that has received or applied for tax-exempt status described
5 under Section 501(c)(3) of the Internal Revenue Code of 1986,
6 (ii) an agent's fee or commission, or (iii) funds reported
7 under Article 9 of the Election Code.
8 "Travel expense" means the necessary and reasonable cost
9 of transportation and the necessary and reasonable cost of
10 lodging and meals incurred while a person is away from his or
11 her residence or principal place of employment.
12 (c) Any honorarium or honoraria accepted in violation of
13 this Section shall be surrendered to the State Treasurer and
14 deposited into the General Revenue Fund.

17 Sec. 3-101.
18 (a) No official as defined in Section 2 of the Lobbyist
19 Registration Act may receive anything of value from a person
20 or entity required to register as a lobbyist under the
21 Lobbyist Registration Act, regardless of whether that person
22 or entity actually registered under the Act. No legislator
23 may solicit, accept, or agree to accept, gifts, loans,
24 gratuities, discounts, favors, hospitality, or services
25 having an aggregate value of $100 or more in any calendar
26 year from any one person known to have legislative interests,
27 under circumstances from which it could reasonably be
28 inferred that a major purpose of the donor is to influence
29 him in the performance of his official duties.
30 (b) This Section does not apply to:
31 (1) any political contribution, in cash or in kind, if
32 such contribution is actually used for political purposes, is
33 required to be and is reported under Article 9 of the

1 Election Code, and does not violate any law; (2) the purchase
2 of tickets to, or advertisements in journals for, political
3 or testimonial dinners; or
4 (2)(3) a commercially reasonable loan evidenced in
5 writing with repayment due by a date certain made in the
6 ordinary course of business;.
7 (3) gifts of nominal value, such as plaques, trophies,
8 or certificates, given in recognition of the official's
9 public service;
10 (4) novelty items of less than $25 value given as
11 mementos of the official's participation in a public event;
12 (5) meals and drinks;
13 (6) publications intended to provide information in a
14 field within the official's public duties.

16 Section 10. The Lobbyist Registration Act is amended by
17 adding Section 6.5 as follows:
18 (25 ILCS 170/6.5 new)
19 Sec. 6.5. Copy of reports to officials.
20 (a) Every person required to register as prescribed
21 in Section 3 and required to file a report with the
22 Secretary of State as prescribed in Section 6 shall, at
23 the time of filing the report, also provide a copy of the
24 report to each official listed in the report by first
25 class mail or hand delivery.
26 (b) Failure to provide a copy of the report to an
27 official listed in the report within the time designated in
28 Section 6 shall constitute a violation of this Act.
29 Section 99. This Act takes effect upon becoming law.".
