Amends the Liquor Control Act of 1934 and the Civil
Administrative Code of Illinois. Requires all retailers who
sell any alcoholic beverages for consumption on the premises
to post, in a conspicuous place, a sign which clearly reads:
"Warning: Drinking alcoholic beverages during pregnancy can
cause birth defects." Requires the Department of Revenue to
make such warning signs available to retailers of alcoholic
beverages. Permits the Department to charge a fee to cover
printing, postage, and handling expenses. Provides that a
violation of this provision is a Class C misdemeanor.
Imposes a fine for violations of this prohibition. Provides
that the Department of Public Health shall enforce this
provision.

1 AN ACT in relation to alcohol, amending named Acts.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Civil Administrative Code of Illinois is
5 amended by adding Section 55.84 as follows:
6 (20 ILCS 2310/55.84 new)
7 Sec. 55.84. To inspect the premises of a retailer who
8 sells alcoholic beverages for consumption on the premises and
9 to enforce the requirement that such retailers post signs as
10 required under Section 6-31 of the Liquor Control Act of
11 1934.
12 Section 10. The Liquor Control Act of 1934 is amended by
13 adding Section 6-31 as follow:

15 Sec. 6-31. Warning signs.
16 (a) A retailer who sells alcoholic beverages for
17 consumption on the premises shall post, in a conspicuous
18 place, a sign that clearly reads: "Warning: Drinking
19 alcoholic beverages during pregnancy can cause birth
20 defects." The sign shall include a picture, occupying not
21 less than one-half of the sign, illustrating a pregnant woman
22 and the international red "prohibited" symbol over an
23 alcoholic beverage. The illustration shall be no smaller than
24 11 inches by 17 inches.
25 (b) The Department shall make such warning signs
26 available to retailers of alcoholic beverages and shall
27 promulgate rules with respect to the form and the posting of
28 such signs. A fee may be charged by the Department to cover
29 printing, postage, and handling expenses.

1 (c) A person who fails or refuses to post the sign as
2 required in this Section shall be guilty of a Class C
3 misdemeanor. A person who violates subsection (a) shall also
4 be liable for a civil fine in an amount not to exceed $150
5 for the first violation or $500 for a second violation or
6 subsequent violation. Such fine shall be imposed and
7 collected by the Department of Public Health after providing
8 the person with due process and an opportunity to be heard.
