1 AN ACT to amend the Illinois Highway Code by changing
2 Section 6-207.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Highway Code is amended by
6 changing Section 6-207 as follows:

8 Sec. 6-207. Compensation of highway commissioner and
9 other officers.
10 (a) Unless an annual salary is fixed as provided in this
11 Section, the highway commissioner shall receive for each day
12 he or she is necessarily employed in the discharge of
13 official duties a per diem to be fixed by the county board in
14 road districts in counties not under township organization,
15 by the highway board of trustees in consolidated township
16 road districts, and by the board of town trustees in
17 districts composed of a single township. Before any per diem
18 is paid, a sworn statement shall be filed by the commissioner
19 in the office of the district clerk, showing the number of
20 days the commissioner was employed, the kind of employment,
21 and the dates of employment.
22 The boards specified in the preceding paragraph may,
23 instead of a per diem, fix an annual salary for the highway
24 commissioner at not less than $3,000, to be paid in equal
25 monthly installments. The boards shall fix the compensation
26 of the commissioner, whether an annual salary or a per diem,
27 on or before the last Tuesday in March before the date of
28 election of the commissioner.
29 If the term of any highway commissioner is extended by
30 operation of law, the board that fixes the commissioner's
31 rate of compensation may increase the rate of the

1 compensation, within the limits provided in this Section, in
2 relation to that portion of the commissioner's term that
3 extends beyond the period for which he or she was elected.
4 The board of town trustees shall order payment of the
5 amount of per diem claimed in the highway commissioner's
6 sworn statement at the first regular meeting following the
7 filing of the statement. In consolidated township road
8 districts, the compensation and the expenses of the offices
9 of the highway commissioner, district clerk, and district
10 treasurer shall be audited by the highway board of trustees.
11 The compensation of the highway commissioner shall be
12 paid from the general township fund in districts comprised of
13 a single township and shall be paid from the regular road
14 fund in all other districts having highway commissioners;
15 however, in districts comprised of a single township, a
16 portion (not exceeding 50%) of the highway commissioner's
17 salary may be paid from the corporate road and bridge fund or
18 the permanent road fund if approved by the township board and
19 the highway commissioner.
20 (b) The officers composing the highway board of trustees
21 in consolidated township road districts shall be entitled to
22 $3 per day for attending meetings of the board, to be paid
23 out of the town fund of their respective townships. In
24 consolidated township road districts, the compensation of the
25 district clerk and the district treasurer shall be paid out
26 of the road fund of the district.
27 (c) The district clerk shall receive:
28 (1) for each day he or she is necessarily employed
29 in the discharge of official duties, a per diem to be
30 fixed by the county board in road districts in counties
31 not under township organization, by the highway board of
32 trustees in consolidated township road districts, and by
33 the board of town trustees in districts composed of a
34 single township; or

1 (2) $4 per day for each day he or she shall be
2 required to meet with the highway commissioner and the
3 same amount per day for the time he or she shall be
4 employed in canvassing the returns of elections. The
5 district clerk shall receive no other per diem. In
6 addition to the above, the district clerk shall also
7 receive fees for the following services, to be paid out
8 of the district road fund, except where otherwise
9 specified:
10 (A) (1) For serving notice of election or
11 appointment upon district officers as required by
12 this Code, 25 cents each.
13 (B) (2) For posting up notices required by
14 law, 25 cents each.
15 (C) (3) For copying any record in the district
16 clerk's office and certifying to the copy, 10 cents
17 for every 100 words, to be paid by the person
18 applying for the certified copy.
19 (d) Except as otherwise provided in this Code, the
20 district treasurer shall, in addition to any other
21 compensation to which he or she is by law entitled, receive
22 an annual salary of not less than $100 nor more than $1,000
23 per year to be fixed by the county board in road districts in
24 counties not under township organization, by the highway
25 board of trustees in consolidated township road districts,
26 and by the board of town trustees in districts composed of a
27 single township.
28 The compensation of the district treasurer shall be paid
29 from the general township fund in districts composed of a
30 single township and shall be paid from the regular road fund
31 in all other districts having district treasurers.
