Amends the Illinois Highway Code. Provides that the term
of the county superintendent of highways shall be for a
period of one to 6 years and that the length of the term
shall be in the discretion of the county board (instead of a
term of 6 years). Effective immediately.

1 AN ACT to amend the Illinois Highway Code by changing
2 Section 5-202.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Highway Code is amended by
6 changing Section 5-202 as follows:
7 (605 ILCS 5/5-202) (from Ch. 121, par. 5-202)
8 Sec. 5-202. (a) Except as provided under subsection (b)
9 of this Section the term of office of each county
10 superintendent of highways shall be for a period of one to 6
11 years. The length of the term shall be in the discretion of
12 the county board. The term shall continue is 6 years and
13 until his successor is appointed and qualified. He shall
14 receive a salary fixed by the county board, and shall also be
15 allowed his actual traveling and other expenses incurred in
16 the discharge of the duties of his office, his salary and
17 expenses to be payable out of any general or highway funds of
18 the county. The county board shall provide all equipment and
19 personnel reasonably required by the county superintendent of
20 highways in the discharge of the duties of his office.
21 (b) Each county superintendent of highways appointed in
22 a county of more than 600,000 inhabitants but less than
23 3,000,000 inhabitants shall serve at the pleasure of the
24 county board beginning with the first appointee to take
25 office after the expiration of the remaining term of the
26 county superintendent of highways in office on the effective
27 date of this amendatory Act of 1985.

29 Section 99. Effective date. This Act takes effect upon
30 becoming law.
