Amends the Bingo License and Tax Act. Provides that in
certain counties the maximum prize awarded for a single game
may not exceed $3,250 (now $500). Permits in those counties
the roll-over of prizes not won in a game of bingo into the
next game.

1 AN ACT to amend the Bingo License and Tax Act by changing
2 Section 2.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Bingo License and Tax Act is amended by
6 changing Section 2 as follows:
7 (230 ILCS 25/2) (from Ch. 120, par. 1102)
8 Sec. 2. The conducting of bingo is subject to the
9 following restrictions:
10 (1) The entire net proceeds from bingo play must be
11 exclusively devoted to the lawful purposes of the
12 organization permitted to conduct that game.
13 (2) No person except a bona fide member of the
14 sponsoring organization or a bona fide member of an auxiliary
15 organization, substantially all of whose members are spouses
16 of members of the sponsoring organization may participate in
17 the management or operation of the game.
18 (3) No person may receive any remuneration or profit for
19 participating in the management or operation of the game,
20 except that if an organization licensed under this Act is
21 associated with a school or other educational institution,
22 that school or institution may reduce tuition or fees for a
23 designated pupil based on participation in the management or
24 operation of the game by any member of the organization. The
25 extent to which tuition and fees are reduced shall relate
26 proportionately to the amount of time volunteered by the
27 member, as determined by the school or other educational
28 institution.
29 (4) Except as provided in paragraph (4.1), the aggregate
30 retail value of all prizes or merchandise awarded in any
31 single day of bingo may not exceed $2,250, except that in

1 adjoining counties having 200,000 to 275,000 inhabitants
2 each, and in counties which are adjacent to either of such
3 adjoining counties and are adjacent to a total of not more
4 than 2 counties in this State, and in any municipality having
5 2,500 or more inhabitants and within one mile of such
6 adjoining and adjacent counties having less than 25,000
7 inhabitants, 2 additional bingo games may be conducted after
8 the $2,250 limit has been reached. The prize awarded for any
9 one game, including any game conducted after reaching the
10 $2,250 limit as authorized in this paragraph (4), may not
11 exceed $500 cash or its equivalent.
12 (4.1) In adjoining counties having at least 200,000 but
13 no more than 275,000 inhabitants each, and in counties that
14 are adjacent to either of such adjoining counties and
15 adjacent to a total of not more than 2 counties in this
16 State, and in any municipality having 2,500 or more
17 inhabitants and within one mile of such adjoining and
18 adjacent counties having less than 25,000 inhabitants, the
19 aggregate retail value of all prizes or merchandise awarded
20 in any single day of bingo may not exceed $3,250. All prizes
21 not won in a game of bingo under this paragraph (4.1) may be
22 rolled over into the next game and may be awarded in addition
23 to the prizes authorized for the later game. The prize
24 awarded for any one game pursuant to this paragraph (4.1) may
25 not exceed $3,250.
26 (5) The number of games may not exceed 25 in any one day
27 including regular and special games, except that this
28 restriction on the number of games shall not apply to bingo
29 conducted at the Illinois State Fair or any county fair held
30 in Illinois.
31 (6) The price paid for a single card under the license
32 may not exceed $1 and such card is valid for all regular
33 games on that day of bingo. A maximum of 5 special games may
34 be held on each bingo day, except that this restriction on

1 the number of special games shall not apply to bingo
2 conducted at the Illinois State Fair or any county fair held
3 in Illinois. The price for a single special game card may not
4 exceed 50 cents.
5 (7) The number of bingo days conducted by a licensee
6 under this Act is limited to one per week, except as follows:
7 (i) Bingo may be conducted in accordance with the
8 terms of a special operator's permit or limited license
9 issued under subdivision (3) of Section 1.
10 (ii) Bingo may be conducted at the Illinois State
11 Fair or any county fair held in Illinois under
12 subdivision (3) of Section 1.
13 (iii) A licensee which cancels a day of bingo
14 because of inclement weather or because the day is a
15 holiday or the eve of a holiday may, after giving notice
16 to the Department, conduct bingo on an additional date
17 which falls on a day of the week other than the day
18 authorized under the license. As used in this
19 subdivision (iii), "holiday" means any of the holidays
20 listed in Section 17 of the Promissory Note and Bank
21 Holiday Act.
22 (8) A licensee may rent a premises on which to conduct
23 bingo only from an organization which is licensed as a
24 provider of premises or exempt from license requirements
25 under this Act. If the organization providing the premises is
26 a metropolitan exposition, auditorium, and office building
27 authority created by State law, a licensee may enter into a
28 rental agreement with the organization authorizing the
29 licensee and the organization to share the gross proceeds of
30 bingo games; however, the organization shall not receive more
31 than 50% of the gross proceeds.
32 (9) No person under the age of 18 years may play or
33 participate in the conducting of bingo. Any person under the
34 age of 18 years may be within the area where bingo is being

1 played only when accompanied by his parent or guardian.
2 (10) The promoter of bingo games must have a proprietary
3 interest in the game promoted.
4 (11) Raffles or other forms of gambling prohibited by
5 law shall not be conducted on the premises where bingo is
6 being conducted, except that pull tabs and jar games
7 conducted under the Illinois Pull Tabs and Jar Games Act may
8 be conducted on the premises where bingo is being conducted.
9 Prizes awarded in pull tabs and jar games shall not be
10 included in the bingo prize limitation.
11 (12) An organization holding a special operator's permit
12 or a limited license may, as one of the occasions allowed by
13 such permit or license, conduct bingo for a maximum of 2
14 consecutive days, during each day of which the number of
15 games may exceed 25, and regular game cards need not be valid
16 for all regular games. If only noncash prizes are awarded
17 during such occasions, the prize limits stated in paragraph
18 (4) of this Section shall not apply, provided that the retail
19 value of noncash prizes for any single game shall not exceed
20 $150.
