1 AMENDMENT TO HOUSE BILL 1265
2 AMENDMENT NO. . Amend House Bill 1265 by replacing
3 the title with the following:
4 "AN ACT to amend the Illinois Insurance Code by changing
5 Section 351B-3."; and
6 by replacing everything after the enacting clause with the
7 following:
8 "Section 5. The Illinois Insurance Code is amended by
9 changing Section 351B-3 as follows:
10 (215 ILCS 5/351B-3) (from Ch. 73, par. 963B-3)
11 Sec. 351B-3. Small employer group accident and health
12 insurance.
13 (a) Small employer group accident and health insurance
14 is hereby declared to be that form of accident and health
15 insurance that provides coverage for each person insured
16 under the group policy for the expenses incurred because of
17 care rendered by a physician or hospital for the treatment of
18 an injury or sickness and which covers not more than 25
19 employees, members, or employees of members (exclusive of
20 dependents) written under a master policy issued to any
21 governmental corporation, unit, agency, or department thereof

1 or to any corporation, copartnership, or individual employer
2 or to any association upon application of an executive
3 officer or trustee of an association having a constitution or
4 bylaws and formed in good faith for purposes other than that
5 of obtaining insurance, where officers, members, employees,
6 or employees of members or classes or departments thereof may
7 be insured for their individual benefit. In addition, a
8 small employer group accident and health policy may be
9 written to insure any group that may be insured under a group
10 life insurance policy as long as the number of employees,
11 members, or employees of members (exclusive of dependents)
12 does not exceed 25. The term "employees" shall include the
13 officers, managers, and employees of subsidiary or affiliated
14 corporations, and the individual proprietors, partners, and
15 employees of affiliated individuals or firms when the
16 business of the subsidiary or affiliated corporations or
17 affiliated firms or individuals is controlled by a common
18 employer through stock ownership, contract, or otherwise.
19 (b) For the purpose of providing coverage authorized
20 under this Article a trust composed of employers or members
21 each of which has 25 or fewer employees (exclusive of
22 dependents) may serve as the master policyholder.
