65 ILCS 5/3.1-35-65 from Ch. 24, par. 3.1-35-65
Amends the Illinois Municipal Code. Provides that a
municipality may publish the information provided in its
annual financial report at least once in a newspaper
published in the municipality rather than publish each
account. Requires the publication to state that a copy of
the complete financial statement for the municipality and the
independent auditor's report is available for inspection at
the office of the treasurer of the municipality. Provides
that, if the municipality publishes the annual financial
report rather than publish each account, then the municipal
treasurer shall provide the municipal clerk with the
information provided in the annual financial report rather
than show in the account all moneys (i) received by the
municipality with a general statement concerning the source
of the receipts and (ii) paid out by the municipality when
the total amount paid during the fiscal year exceeds $2,500
in the aggregate. Removes the provision requiring the
treasurer to show in the account a summary statement of
operations for all funds and account groups of the
municipality.

1 AN ACT to amend the Illinois Municipal Code by changing
2 Section 3.1-35-65.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Municipal Code is amended by
6 changing Section 3.1-35-65 as follows:
7 (65 ILCS 5/3.1-35-65) (from Ch. 24, par. 3.1-35-65)
8 Sec. 3.1-35-65. Treasurer; annual accounts.
9 (a) Within 6 months after the end of each fiscal year,
10 the treasurer of each municipality having a population of
11 less than 500,000, as determined by the last preceding
12 federal census, shall annually prepare and file with the
13 clerk of the municipality an account of moneys received and
14 expenditures incurred during the preceding fiscal year as
15 specified in this Section. The treasurer shall show in the
16 account:
17 (1) All moneys received by the municipality,
18 indicating the total amounts, in the aggregate, received
19 in each account of the municipality, with a general
20 statement concerning the source of receipts. In this
21 paragraph, the term "account" does not mean each
22 individual taxpayer, householder, licensee, utility user,
23 or other persons whose payments to the municipality are
24 credited to a general account.
25 (2) Except as provided in paragraph (3) of this
26 subsection (a), all moneys paid out by the municipality
27 where the total amount paid during the fiscal year
28 exceeds $2,500 in the aggregate, giving the name of each
29 person to whom moneys were paid and the total paid to
30 each person.
31 (3) All moneys paid out by the municipality as

1 compensation for personal services, giving the name of
2 each person to whom moneys were paid and the total amount
3 paid to each person from each account.
4 (4) A summary statement of operations for all funds
5 and account groups of the municipality, as excerpted from
6 the annual financial report as filed with the appropriate
7 State agency.
8 (b) Upon receipt of the account from the municipal
9 treasurer, the municipal clerk shall publish the account at
10 least once in one or more newspapers published in the
11 municipality or, if no newspaper is published in the
12 municipality, then in one or more newspapers having a general
13 circulation within the municipality. In municipalities with a
14 population of less than 500 in which no newspaper is
15 published, however, publication may be made by posting a copy
16 of the account in 3 prominent places within the municipality.
17 (c) If a municipality publishes the information provided
18 in the annual financial report at least once in one or more
19 newspapers published in the municipality, the municipality
20 shall be deemed to have met all of the publication
21 requirements of this Section. A publication under this
22 subsection shall state that a copy of the complete financial
23 statement for the municipality and the independent auditor's
24 report is available for inspection at the office of the
25 treasurer of the municipality. If a municipality publishes
26 the information provided in the annual financial report, then
27 the municipal treasurer shall provide the municipal clerk
28 with the information provided in the Annual Financial Report
29 filed with the State Comptroller as required by Section 8-8-3
30 for publication rather than comply with the provisions of
31 paragraphs (1) and (2) in subsection (a).
