Creates the Retired Professionals Pro Bono Act to allow a
retired person to provide certain professional services to
State agencies and not-for-profit organizations under a
limited pro bono license.

1 AN ACT to create the Retired Professionals Pro Bono Act.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 1. Short title. This act may be cited as the
5 Retired Professionals Pro Bono Act.
6 Section 5. Legislative purpose. Retired professionals
7 have skills and expertise that meet the needs of many
8 organizations and institutions that are unable to pay for
9 their level of services. It is therefore in the public
10 interest to allow certain retired professionals to practice
11 in their trained profession under a limited license on a pro
12 bono basis.
13 Section 10. Pro bono license issuance. The Department
14 of Professional Regulation or the Department of Public
15 Health, as appropriate, shall issue a pro bono license to a
16 person who:
17 (1) engaged in the practice of a profession
18 regulated by the Department of Professional Regulation or
19 the Department of Public Health under Chapter 225 of the
20 Illinois Compiled Statutes for at least 15 of the 25
21 years immediately preceding the application request;
22 (2) has never been disciplined for misconduct in
23 the profession which he or she practiced under
24 subdivision (1);
25 (3) agrees to adhere to the practice requirements
26 of the Act under which persons of his or her profession
27 are regulated, excluding education, examination, and
28 licensing requirements, unless otherwise imposed by rule
29 of the Department of Professional Regulation under this
30 Act;

1 (4) has obtained an offer for services from a
2 sponsoring State agency or organization or institution
3 that is conducted on a not-for-profit basis and exempt
4 from federal taxation liability under Section 501(c)(3)
5 of the Internal Revenue Code of 1986; and
6 (5) neither asks for nor receives compensation of
7 any kind for the professional services to be rendered;
8 however, a person licensed under this Section may be
9 reimbursed for actual expenses incurred while rendering
10 services for the sponsoring agency, organization, or
11 institution.
12 Section 15. Scope of license. A person practicing under
13 a pro bono license is authorized to practice only (1) within
14 the scope of the Act regulating the profession for which the
15 license is issued and (2) for an agency or not-for-profit
16 organization or institution.
17 Section 20. Department rules. The Department of
18 Professional Regulation, in consultation with the Department
19 of Public Health, shall adopt rules as necessary to implement
20 this Act. No State agency shall impose a fee upon applicants
21 and licensees under this Act in connection with practice
22 authorized under this Act.
23 Section 25. Change in location of services. If there is
24 a change in the agency, organization, or institution to whom
25 the pro bono licensee renders services, including an
26 additional agency, organization, or institution to whom the
27 licensee renders services, the licensee shall notify the
28 Department of Professional Regulation within 15 days of the
29 change. The Department shall revoke the license if the new
30 sponsor does not meet the requirements of subsection (4) of
31 Section 10.

1 Section 30. Automatic termination of licensure. A pro
2 bono license issued under this Act shall automatically expire
3 2 years from the date of issuance. The Department of
4 Professional Regulation shall provide by rule for the renewal
5 of licenses issued under this Act.
6 Section 35. Professional misconduct. A person licensed
7 to practice under this Act shall be subject to the
8 disciplinary provisions of the Act regulating his or her
9 profession under Chapter 225 of the Illinois Compiled
10 Statutes, in addition to rules adopted by the Department of
11 Professional Regulation under this Act.
