1 AN ACT to amend the Criminal Code of 1961 by changing
2 Section 9-3.1.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Criminal Code of 1961 is amended by
6 changing Section 9-3.1 as follows:
7 (720 ILCS 5/9-3.1) (from Ch. 38, par. 9-3.1)
8 Sec. 9-3.1. Concealment of homicidal death.
9 (a) A person commits the offense of concealment of
10 homicidal death when he conceals the death of any other
11 person with knowledge that the such other person has died by
12 homicidal means.
13 (b) Nothing in this Section prevents the defendant from
14 also being charged with and tried for the first degree
15 murder, second degree murder or involuntary manslaughter of
16 the person whose death is concealed. If a person convicted
17 under this Section is also convicted of first degree murder,
18 second degree murder or involuntary manslaughter, the penalty
19 under this Section shall be imposed separately and in
20 addition to the penalty for first degree murder, second
21 degree murder or involuntary manslaughter.
22 (c) Sentence.
23 Concealment of homicidal death is a Class 3 felony.
