maintain a recognized school to establish and maintain
special educational facilities for children with
disabilities.

1 AN ACT to amend the School Code by changing Section
2 14-4.01.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The School Code is amended by changing
6 Section 14-4.01 as follows:

8 Sec. 14-4.01. Special educational facilities for
9 children with disabilities. School boards of any school
10 districts that maintain a recognized school, whether
11 operating under the general law or under a special charter,
12 subject to any limitations hereinafter specified, shall
13 establish and maintain such special educational facilities as
14 may be needed for children with disabilities as defined in
15 Section 14-1.02 of this Article who are residents of their
16 school district, and such children, residents of other school
17 districts, as may be authorized by this Article.
18 All such school boards shall place or by regulation may
19 authorize the director of special education to place,
20 pursuant to procedures required by this Act and rules and
21 regulations promulgated by the State Board of Education,
22 eligible children into special education programs designed to
23 benefit children with disabilities defined in Sections
24 14-1.02 through 14-1.07 of this Act.
25 All school districts, administrative districts or
26 governing boards responsible for providing special education
27 services shall submit to the appropriate regional
28 superintendent comprehensive plans or modifications thereto
29 for the provision of special education services in accordance
30 with rules promulgated by the State Board of Education.
31 Copies of comprehensive plans or modifications thereto shall

1 be forwarded by the regional superintendent to the State
2 Board of Education. Regional superintendents who provide
3 special education services shall submit comprehensive plans
4 or modifications thereto directly to the State Board of
5 Education. Comprehensive plans or modifications thereto
6 shall be made available by regional superintendents for
7 public inspection during regular business hours.
8 The State Board of Education shall provide for the
9 submission of comprehensive plans not more frequently than
10 once every 3 years but may require the submission of such
11 modifications as it deems necessary to achieve the purposes
12 of this Act and applicable federal law.
