Amends the Public Utilities Act. Requires the Illinois
Commerce Commission to establish a statewide electric utility
reliability standard. Requires the standard to include a
maximum number of electric service outages and a maximum
number of cumulative hours of electric service outages in a
calendar year for any single electric utility customer beyond
which service is deemed unreliable. Requires the Commission
to develop a means of enforcement of the standard that
includes the waiver of the fixed customer charge for any
customer whose electric service has failed to meet the
reliability standard in any given month. Provides that the
utility is responsible for damages incurred by a customer and
caused by a service outage.

1 AN ACT to amend the Public Utilities Act by adding
2 Section 8-209.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Public Utilities Act is amended by adding
6 Section 8-209 as follows:
7 (220 ILCS 5/8-209 new)
8 Sec. 8-209. Utility service reliability standard;
9 enforcement; damages.
10 (a) The Commission shall establish a statewide electric
11 utility service reliability standard. The standard shall be
12 designed so that the service for any customer can be
13 determined to be reliable or unreliable. The standard shall
14 include a maximum number of electric service outages for any
15 single electric utility customer and a maximum cumulative
16 number of hours of electric service outages in a calendar
17 year for any single electric utility customer beyond which
18 service is deemed unreliable. The standard may be different
19 for different rate classes. In setting the appropriate
20 standard, the Commission shall consider the costs that would
21 be incurred to meet a reliability standard and the benefits
22 of improved reliability and improved reliability planning
23 that would result from the creation of the standard. The
24 Commission shall develop a means of enforcement of the
25 reliability standard that shall include, but not be limited
26 to, waiver of the fixed monthly customer charge for any
27 customer whose service has failed to meet the reliability
28 standard.
29 (b) An electric public utility is responsible for all
30 damages incurred by a customer and caused by a service
31 outage.
