New Act
Creates the Contractor Reporting Act. Requires a
contractor doing business in this State to provide the
Department of Commerce and Community Affairs with a copy of
all lawsuits and bankruptcies filed with respect to the
contractor or any businesses previously owned by the
contractor. Also requires a contractor to provide the
Department with a list of all contracting businesses
previously owned by the contractor.

1 AN ACT to create the Contractor Reporting Act.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the
5 Contractor Reporting Act.
6 Section 5. Definitions. For purposes of this Act, the
7 following definitions shall have the following meanings,
8 except where the context requires otherwise:
9 "Contractor" means a person who offers to undertake, or
10 holds himself or herself out as being able to undertake, or
11 does undertake to alter, add to, subtract from, improve,
12 enhance, or beautify any residential realty or construct. The
13 term "contractor" includes a subcontractor, specialty
14 contractor, general engineering contractor, general building
15 contractor, or specialty contractor who performs any of the
16 activities listed in this definition directly or indirectly.
17 "Department" means the Department of Commerce and
18 Community Affairs.
19 "Lawsuit" means a suit in which the contractor was a
20 defendant.
21 Section 10. Previous businesses owned by contractor. A
22 contractor shall provide the Department with a list of all
23 contracting businesses that were owned previously, in whole
24 or in part, by the contractor.
25 Section 15. Lawsuits; bankruptcies. A contractor shall
26 provide the Department with a copy of all of the lawsuits and
27 bankruptcies filed with respect to the contractor and any of
28 the businesses listed in Section 10.

1 Section 20. Disclosure to public. The Department shall
2 compile the information supplied to it under Sections 10 and
3 15 and make it available to the public upon request. The
4 Department shall provide a toll free number to give this
5 information to the public upon request.
