1 AN ACT to amend the Illinois Human Resource Investment
2 Council Act by changing Section 3.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Human Resource Investment
6 Council Act is amended by changing Section 3 as follows:

9 Sec. 3. The Council shall consist of members appointed
10 by the Governor with the advice and consent of the Senate in
11 accordance with the requirements of Section 701 of Title VII
12 of the federal Job Training Partnership Act.
13 (a) At least 15% but not more than 60% of the members
14 shall be representatives of business, industry and
15 agriculture, including persons who are representatives of
16 business and industry on Private Industry Councils in the
17 State.
18 (b) The following State officials shall serve on the
19 Council but shall not constitute more than 60% of the
20 Council's membership: the Director of Commerce and Community
21 Affairs (administering agency for the Job Training
22 Partnership Act and the National and Community Service Act),
23 the Director of Public Aid (administering agency for part F
24 of Title IV of the Social Security Act and the employment
25 program established under Section 6(d)(4) of the Food Stamp
26 Act of 1977), the Director of the Department of Employment
27 Security (administrator of the Wagner-Peyser Act), the State
28 Superintendent of Education (administrator of the Carl D.
29 Perkins Vocational and Applied Technology Education Act and
30 the Adult Education Act), and the Executive Director of the
31 Illinois Community College Board, or their designees. Each

1 member shall serve during the term of his office or
2 employment.
3 (c) At least 15%, but no more than 60% of the members
4 shall be representatives of organized labor. These members
5 shall be selected from among individuals nominated by
6 recognized State labor federations.
7 (d) The Human Resource Investment Council shall include
8 one or more representatives from each of the following:
9 (1) local public education;
10 (2) a postsecondary institution;
11 (3) a secondary or postsecondary vocational
12 education institution; and
13 (4) a community based organization.
14 Representatives from these entities shall constitute no
15 more than 60% of the Council. The total number of
16 representatives appointed under (1), (2), and (3) shall not
17 constitute less than 15% of the membership of the Human
18 Resource Investment Council.
19 (d-5) The Human Resource Investment Council may also
20 include additional qualified members who may be selected from
21 the following, but who shall not constitute more than 60% of
22 the Council:
23 (1) representatives from local welfare agencies;
24 (2) representatives from units of local government
25 or consortia of units of local government appointed from
26 nominations by the chief elected officials of the units
27 of local government or consortia;
28 (3) representatives from public housing agencies;
29 (4) representatives from the State legislature;
30 (5) representatives from any State or local program
31 that receives funding under an applicable federal human
32 resource program that the Governor has determined has a
33 direct interest in the utilization of human resources
34 within the State; and

1 (6) individuals who have special knowledge and
2 qualifications in special education and career
3 development needs of hard-to-serve individuals.
4 (e) In reconstructing the membership of the Council
5 pursuant to subsections (a), (b), (c), (d), and (d-5), as
6 mandated in Section 701 of Title VII of the federal Job
7 Training Partnership Act, as amended, appointments made
8 effective on July 1, 1995 will be given fixed and staggered
9 terms of no less than 2 years. Thereafter, members of the
10 Council shall be appointed for terms of 2 two years expiring
11 on July 1, or until their successors are appointed and
12 qualified. The Governor may at any time make appointments to
13 fill vacancies for the balance of an unexpired term.
14 Vacancies shall be filled in the same manner as the original
15 appointment. Members shall serve without compensation, but
16 shall be reimbursed for necessary expenses incurred in the
17 performance of their duties.
18 (f) The Council shall meet at least 5 five times per
19 calendar year at such times and in such places as it deems
20 necessary. The Council shall be subject to the "Open
21 Meetings Act" and, to the extent required by that law, its
22 meetings shall be publicly announced and open and accessible
23 to the general public. The Council shall adopt such rules
24 and operating procedures as it deems necessary to carry out
25 its responsibilities under this Act and under the federal Job
26 Training Partnership Act.

11 Section 95. No acceleration or delay. Where this Act
12 makes changes in a statute that is represented in this Act by
13 text that is not yet or no longer in effect (for example, a
14 Section represented by multiple versions), the use of that
15 text does not accelerate or delay the taking effect of (i)
16 the changes made by this Act or (ii) provisions derived from
17 any other Public Act.
