1 AN ACT to amend the Illinois Police Training Act by
2 changing Section 9.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Police Training Act is amended
6 by changing Section 9 as follows:
7 (50 ILCS 705/9) (from Ch. 85, par. 509)
8 Sec. 9. Traffic and Criminal Conviction Surcharge Fund.
9 A special fund is hereby established in the State Treasury to
10 be known as "The Traffic and Criminal Conviction Surcharge
11 Fund" and shall be financed as provided in Section 9.1 of
12 this Act and Section 5-9-1 of the "Unified Code of
13 Corrections", unless the fines, costs or additional amounts
14 imposed are subject to disbursement by the circuit clerk
15 under Section 27.5 of the Clerks of Courts Act. Moneys in
16 this Fund shall be expended as follows:
17 (1) A portion of the total amount deposited in the
18 Fund may be used, as appropriated by the General
19 Assembly, for the ordinary and contingent expenses of the
20 Illinois Law Enforcement Training Standards Board;
21 (2) A portion of the total amount deposited in the
22 Fund shall be appropriated for the reimbursement of local
23 governmental agencies participating in training programs
24 certified by the Board, in an amount equaling 1/2 of the
25 total sum paid by such agencies during the State's
26 previous fiscal year for mandated training for
27 probationary police officers or probationary county
28 corrections officers and for optional advanced and
29 specialized law enforcement or county corrections
30 training. These reimbursements may include the costs for
31 tuition at training schools, the salaries of trainees

1 while in schools, and the necessary travel and room and
2 board expenses for each trainee. If the appropriations
3 under this paragraph (2) are not sufficient to fully
4 reimburse the participating local governmental agencies,
5 the available funds shall be apportioned among such
6 agencies, with priority first given to repayment of the
7 costs of mandatory training given to law enforcement
8 officer or county corrections officer recruits, then to
9 repayment of costs of advanced or specialized training
10 for permanent police officers or permanent county
11 corrections officers;
12 (3) A portion of the total amount deposited in the
13 Fund may be used to fund the "Intergovernmental Law
14 Enforcement Officer's In-Service Training Act", veto
15 overridden October 29, 1981, as now or hereafter amended,
16 at a rate and method to be determined by the board;
17 (4) A portion of the Fund also may be used by the
18 Illinois Department of State Police for expenses incurred
19 in the training of employees from any State, county or
20 municipal agency whose function includes enforcement of
21 criminal or traffic law;
22 (5) A portion of the Fund may be used by the Board
23 to fund grant-in-aid programs and services for the
24 training of employees from any county or municipal agency
25 whose functions include corrections or the enforcement of
26 criminal or traffic law.
27 All payments from The Traffic and Criminal Conviction
28 Surcharge Fund shall be made each year from moneys
29 appropriated for the purposes specified in this Section. No
30 more than 50% of any appropriation under this Act shall be
31 spent in any city having a population of more than 500,000.
32 The State Comptroller and the State Treasurer shall from time
33 to time, at the direction of the Governor, transfer from The
34 Traffic and Criminal Conviction Surcharge Fund to the General

1 Revenue Fund in the State Treasury such amounts as the
2 Governor determines are in excess of the amounts required to
3 meet the obligations of The Traffic and Criminal Conviction
4 Surcharge Fund.
