1 AMENDMENT TO HOUSE BILL 1914
2 AMENDMENT NO. . Amend House Bill 1914 by replacing
3 the title with the following:
4 "AN ACT concerning requests for conviction information.";
5 and
6 by replacing everything after the enacting clause with the
7 following:
8 "Section 5. The Illinois Uniform Conviction Information
9 Act is amended by changing Section 8 as follows:
10 (20 ILCS 2635/8) (from Ch. 38, par. 1608)
11 Sec. 8. Form, Manner and Fees for Requesting and
12 Obtaining Conviction Information.
13 (A) The Department shall prescribe the form and manner
14 for requesting and furnishing conviction information pursuant
15 to this Act. The Department shall prescribe the types of
16 identifying information that must be submitted to the
17 Department in order to process any request for conviction
18 information and the form and manner for making such
19 application, consistent with this Act.
20 (B) The Department shall establish the maximum fee it
21 shall charge and assess for processing requests for

1 conviction information, and the Authority shall establish the
2 maximum fee that other criminal justice agencies shall charge
3 and assess for processing requests for conviction information
4 pursuant to this Act. The maximum fee established by the
5 Authority pursuant to this Section shall be at least $30 for
6 each request for conviction information. Such fees shall
7 include the general costs associated with performing a search
8 for all information about each person for which a request is
9 received including classification, search, retrieval,
10 reproduction, manual and automated data processing,
11 telecommunications services, supplies, mailing and those
12 general costs associated with the inquiries required by
13 subsection (B) of Section 9 and Section 13 of this Act, and,
14 when applicable, such fees shall provide for the direct
15 payment to or reimbursement of a criminal justice agency for
16 assisting the requester or the Department pursuant to this
17 Act. In establishing the fees required by this Section, the
18 Department and the Authority may also take into account the
19 costs relating to multiple or automated requests and
20 disseminations and the costs relating to any other special
21 factors or circumstances required by statute or rule. The
22 maximum fees established by the Authority pursuant to this
23 Section shall be reviewed annually, and may be waived or
24 reduced at the discretion of a criminal justice agency.

26 Section 99. Effective date. This Act takes effect upon
27 becoming law.".
