Amends the Department of Human Services Act to allow the
Department to enter into a contract with a not-for-profit
organization to establish a revolving loan program to assist
not-for-profit organizations that work in service
partnerships with the State to maintain and improve their
facilities. Effective July 1, 1997.

1 AN ACT to amend the Department of Human Services Act by
2 adding Section 10-30.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Department of Human Services Act is
6 amended by adding Section 10-30 as follows:
7 (20 ILCS 1305/10-30 new)
8 Sec. 10-30. Revolving loan program to maintain and
9 improve not-for-profit organizations' facilities.
10 (a) The Department may enter into a contract with a
11 not-for-profit organization to establish a revolving loan
12 program for the purpose of assisting Illinois not-for-profit
13 organizations that work in service partnerships with the
14 State to maintain and improve their facilities.
15 (b) The contract shall require all of the following:
16 (1) All principal to be used by the not-for-profit
17 organization to make loans to qualifying borrowers, to
18 serve as collateral for borrowers, and to leverage other
19 private funds.
20 (2) Participation by a Department representative in
21 screening applicants.
22 (3) Interest to be used to defray administrative
23 costs for borrowers and the not-for-profit organization,
24 including but not limited to legal fees, underwriting
25 costs, and the cost of required environmental studies.
26 (4) Repaid principal to be used for the same
27 purpose as original principal.
28 (c) This revolving loan program shall be used for the
29 following purposes:
30 (1) To assist not-for-profit organizations in
31 meeting regulatory standards.

1 (2) To enable not-for-profit organizations to
2 comply with the Americans with Disabilities Act.
3 (3) To enable not-for-profit organizations to
4 remove lead and asbestos from their buildings.
5 (4) To encourage not-for-profit organizations to
6 voluntarily make building improvements that increase or
7 improve their ability to serve clients.
8 (5) To support facilities that are appropriate to
9 meeting the goals of the Department, including program
10 mergers, program consolidations, more strategic placement
11 of programs, and more efficient use of space.
12 Section 99. Effective date. This Act takes effect July
13 1, 1997.
