1 AMENDMENT TO HOUSE BILL 2164
2 AMENDMENT NO. . Amend House Bill 2164 on page 1, by
3 replacing lines 21 through 31 with the following:
4 "(c) (1) Hazardous fluorescent and high intensity
5 discharge lamps are hereby designated as a category of
6 universal waste subject to the streamlined hazardous
7 waste rules set forth in Title 35 of the Illinois
8 Administrative Code, Subtitle G, Chapter I, Subchapter c,
9 Part 733 ("Part 733"). Within 60 days of the effective
10 date of this amendatory Act of 1997 the Agency shall
11 propose, and within 180 days of receipt of the Agency's
12 proposal the Board shall adopt, rules that reflect this
13 designation and that prescribe procedures and standards
14 for the management of hazardous fluorescent and high
15 intensity discharge lamps as universal waste. By December
16 31, 1997, the Board shall seek authorization from the
17 United States Environmental Protection Agency to include
18 hazardous fluorescent and high intensity discharge lamps
19 as a category of universal waste subject to the
20 streamlined hazardous waste regulations set forth in
21 Title 35 of the Illinois Administrative Code, Subtitle G,
22 Chapter I, Subchapter c, Part 733. If the United States
23 Environmental Protection Agency authorizes the addition,
24 within 180 days of that authorization, the Agency shall

1 propose and the Board shall amend its rules to designate
2 hazardous fluorescent and high intensity discharge lamps
3 as universal waste subject to the streamlined
4 regulations.
5 (2) If the United States Environmental Protection
6 Agency adopts streamlined hazardous waste regulations
7 pertaining to the management of fluorescent and high
8 intensity discharge lamps, or otherwise exempts those
9 lamps from regulation as hazardous waste before
10 authorization is provided under subsection (c)(1), as an
11 alternative to adopting a rule as provided for under
12 subsection (c)(1), the Board shall adopt an equivalent
13 rule in accordance with Section 7.2 of this Act within
14 180 days of adoption of the federal regulation. The
15 equivalent Board rule may serve as an alternative to the
16 rules adopted under subdivision (1) of this subsection.";

18 on page 2, by deleting lines 1 through 16.
