30 ILCS 105/24.10 new
Creates the Human Cloning Prohibition Act. Prohibits the
cloning of human beings and the use of public funds or
property to clone human beings. Makes intentional violation
a Class 4 felony. Amends the State Finance Act to provide
that an appropriation Act shall not be construed to authorize
the expenditure of public funds for human cloning or for the
support of any project or institution that engages in human
cloning. Effective immediately.

1 AN ACT in relation to human cloning.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the
5 Human Cloning Prohibition Act.
6 Section 5. Definition. For the purposes of this Act,
7 "human cloning" means the intentional manipulation of a human
8 egg cell to make it genetically identical to another human
9 being, living or dead. "Human cloning" does not include:
10 (1) In vitro fertilization, the administration of
11 fertility-enhancing drugs, or other medical procedures
12 used to assist a woman in becoming or remaining pregnant,
13 so long as that pregnancy is not specifically intended to
14 result in the production of a child who is genetically
15 identical to another human being, living or dead.
16 (2) Any activity or procedure that results,
17 directly or indirectly, in 2 or more natural identical
18 twins.
19 Section 10. Prohibitions; penalty.
20 (a) It is unlawful to engage in human cloning within
21 this State.
22 (b) It is unlawful to allow any public funds or property
23 to be used for human cloning.
24 (c) A person who intentionally violates subsection (a)
25 or (b) of this Section commits a Class 4 felony.
26 Section 90. The State Finance Act is amended by adding
27 Section 24.10 as follows:

1 Sec. 24.10. Use of public funds for human cloning. An
2 appropriation Act enacted after the effective date of this
3 Section shall not be construed to authorize the expenditure
4 of public funds for human cloning, as that term is defined in
5 the Human Cloning Prohibition Act, or for the support of any
6 project or institution that engages in human cloning.
7 Section 99. Effective date. This Act takes effect upon
8 becoming law.
