Amends the Illinois Emergency Management Agency Act and
the General Obligation Bond Act. Requires the Agency to
establish, in cooperation with other State agencies, a
computer system that will enable disaster victims to promptly
contact State or federal agencies electronically for the
purpose of applying for governmental benefits for which the
disaster victim may be entitled. Authorizes the State to
issue $100,000,000 in intermediate or long-term general
obligation bonds, with maturity not to exceed 40 years.

1 AN ACT in relation to State services, amending named
2 Acts.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Emergency Management Agency Act
6 is amended by changing Sections 5 and 9 as follows:

8 Sec. 5. Illinois Emergency Management Agency.
9 (a) There is created within the executive branch of the
10 State Government an Illinois Emergency Management Agency and
11 a Director of the Illinois Emergency Management Agency,
12 herein called the "Director" who shall be the head thereof.
13 The Director shall be appointed by the Governor, with the
14 advice and consent of the Senate, and shall serve for a term
15 of 2 years beginning on the third Monday in January of the
16 odd-numbered year, and until his successor is appointed and
17 has qualified; except that the term of the first Director
18 appointed under this Act shall expire on the third Monday in
19 January, 1989. The Director shall not hold any other
20 remunerative public office. The Director shall receive an
21 annual salary of $70,197 or the amount set by the
22 Compensation Review Board, whichever is higher.
23 (b) The Illinois Emergency Management Agency shall
24 obtain, under the provisions of the Personnel Code,
25 technical, clerical, stenographic and other administrative
26 personnel, and may make expenditures within the appropriation
27 therefor as may be necessary to carry out the purpose of this
28 Act. The agency created by this Act is intended to be a
29 successor to the agency created under the Illinois Emergency
30 Services and Disaster Agency Act of 1975 and the personnel,
31 equipment, records, and appropriations of that agency are

1 transferred to the successor agency as of the effective date
2 of this Act.
3 (c) The Director, subject to the direction and control
4 of the Governor, shall be the executive head of the Illinois
5 Emergency Management Agency and the State Emergency Response
6 Commission and shall be responsible under the direction of
7 the Governor, for carrying out the program for emergency
8 management of this State. He shall also maintain liaison and
9 cooperate with the emergency management organizations of this
10 State and other states and of the federal government.
11 (d) The Illinois Emergency Management Agency shall take
12 an integral part in the development and revision of political
13 subdivision emergency operations plans prepared under
14 paragraph (f) of Section 10. To this end it shall employ or
15 otherwise secure the services of professional and technical
16 personnel capable of providing expert assistance to the
17 emergency services and disaster agencies. These personnel
18 shall consult with emergency services and disaster agencies
19 on a regular basis and shall make field examinations of the
20 areas, circumstances, and conditions that particular
21 political subdivision emergency operations plans are intended
22 to apply, and may recommend revisions under State rules.
23 (e) The Illinois Emergency Management Agency and
24 political subdivisions shall be encouraged to form an
25 emergency management advisory committee composed of private
26 and public personnel representing the emergency management
27 phases of mitigation, preparedness, response, and recovery.
28 (f) The Illinois Emergency Management Agency shall:
29 (1) Coordinate the overall emergency management
30 program of the State.
31 (2) Cooperate with local governments, the federal
32 government and any public or private agency or entity in
33 achieving any purpose of this Act and in implementing
34 emergency management programs for mitigation,

1 preparedness, response, and recovery.
2 (3) Prepare, for issuance by the Governor,
3 executive orders, proclamations, and regulations as
4 necessary or appropriate in coping with disasters.
5 (4) Promulgate rules and requirements for political
6 subdivision emergency operations plans, in accordance
7 with federal guidelines.
8 (5) Review political subdivision emergency
9 operations plans and recommend revisions under State
10 rules.
11 (6) Determine requirements of the State and its
12 political subdivisions for food, clothing, and other
13 necessities in event of a disaster.
14 (7) Establish a register of persons with types of
15 emergency management training and skills in mitigation,
16 preparedness, response, and recovery.
17 (8) Establish a register of government and private
18 response resources available for use in a disaster.
19 (8.5) Establish, in cooperation with other State
20 agencies, a computer system that will enable disaster
21 victims to promptly contact State or federal agencies
22 electronically for the purpose of applying for
23 governmental benefits for which the disaster victim may
24 be entitled.
25 (9) Expand the Earthquake Awareness Program and its
26 efforts to distribute earthquake preparedness materials
27 to schools, political subdivisions, community groups,
28 civic organizations, and the media. Emphasis will be
29 placed on those areas of the State most at risk from an
30 earthquake. Maintain the list of all school districts,
31 hospitals, airports, power plants, including nuclear
32 power plants, lakes, dams, emergency response facilities
33 of all types, and all other major public or private
34 structures which are at the greatest risk of damage from

1 earthquakes under circumstances where the damage would
2 cause subsequent harm to the surrounding communities and
3 residents.
4 (10) Disseminate all information, completely and
5 without delay, on water levels for rivers and streams and
6 any other data pertaining to potential flooding supplied
7 by the Division of Water Resources within the Department
8 of Natural Resources to all political subdivisions to the
9 maximum extent possible.
10 (11) Develop agreements with medical supply and
11 equipment firms to supply resources as are necessary to
12 respond to an earthquake or any other disaster as defined
13 in this Act. These resources will be made available upon
14 notifying the vendor of the disaster. Payment for the
15 resources will be in accordance with Section 7 of this
16 Act. The Illinois Department of Public Health shall
17 determine which resources will be required and requested.
18 (12) Do all other things necessary, incidental or
19 appropriate for the implementation of this Act.

22 Sec. 9. Financing. (a) It is the intent of the
23 Legislature and declared to be the policy of the State that
24 funds to meet disasters shall always be available.
25 (b) It is the legislative intent that the first recourse
26 shall be to funds regularly appropriated to State and
27 political subdivision departments and agencies. If the
28 Governor finds that the demands placed upon these funds in
29 coping with a particular disaster are unreasonably great, he
30 may make funds available from the Disaster Relief Fund. If
31 monies available from the Fund are insufficient, and if the
32 Governor finds that other sources of money to cope with the
33 disaster are not available or are insufficient, the Governor

1 shall request the General Assembly to enact legislation as it
2 may deem necessary to transfer and expend monies appropriated
3 for other purposes or borrow, for a term not to exceed 2
4 years from the United States government or other public or
5 private source. If the General Assembly is not sitting in
6 regular session to enact such legislation for the transfer,
7 expenditure or loan of such monies, and the President of the
8 Senate and the Speaker of the House certify that the Senate
9 and House are not in session, the Governor is authorized to
10 carry out those decisions until such time as a quorum of the
11 General Assembly can convene in a regular or extraordinary
12 session.
13 (b-5) For the purpose of establishing the computer
14 system mandated by paragraph (8.5) of subsection (f) of
15 Section 5 of this Act, the State may issue intermediate or
16 long-term general obligation bonds, with maturity not to
17 exceed 40 years.
18 (c) Nothing contained in this Section shall be construed
19 to limit the Governor's authority to apply for, administer
20 and expend grants, gifts or payments in aid of disaster
21 mitigation, preparedness, response or recovery.

23 Section 10. The General Obligation Bond Act is amended by
24 changing Section 2 and adding Section 6c as follows:

26 Sec. 2. Authorization for Bonds. The State of Illinois
27 is authorized to issue, sell and provide for the retirement
28 of General Obligation Bonds of the State of Illinois in the
29 total amount of $8,905,508,392 $8,805,508,392 herein called
30 "Bonds".
31 Of the total amount of bonds authorized above, up to
32 $2,200,000,000 in aggregate original principal amount may be

1 issued and sold in accordance with the Baccalaureate Savings
2 Act in the form of General Obligation College Savings Bonds.
3 Of the total amount of bonds authorized above, up to
4 $300,000,000 in aggregate original principal amount may be
5 issued and sold in accordance with the Retirement Savings Act
6 in the form of General Obligation Retirement Savings Bonds.
7 The issuance and sale of Bonds pursuant to the General
8 Obligation Bond Act is an economical and efficient method of
9 financing the capital needs of the State. This Act will
10 permit the issuance of a multi-purpose General Obligation
11 Bond with uniform terms and features. This will not only
12 lower the cost of registration but also reduce the overall
13 cost of issuing debt by improving the marketability of
14 Illinois General Obligation Bonds.
15 Bonds shall be issued for the categories and specific
16 purposes expressed in Sections 2 through 8 and Section 16 of
17 this Act.

20 Sec. 6c. Computer system. The amount of $100,000,000 is
21 authorized to be used by the Illinois Emergency Management
22 Agency for the purpose of establishing, in cooperation with
23 other State agencies, the computer system mandated by
24 paragraph (8.5) of subsection (f) of Section 5 of the
25 Illinois Emergency Management Agency Act.
