Amends the Illinois Dental Practice Act to allow dental
hygienists to provide dental hygiene services without fee
under the general supervision of a dentist, where the dentist
is not required to be present, to residents of senior
citizens' retirement homes.

1 AN ACT to amend the Illinois Dental Practice Act by
2 changing Section 18.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Dental Practice Act is amended
6 by changing Section 18 as follows:

9 Sec. 18. Acts Constituting the Practice of Dental
10 Hygiene. Limitations. A dental hygienist may only be
11 employed or engaged:
12 (a) Under the supervision of a dentist:
13 (1) In the office of a dentist; or
14 (2) By a federal, State, county or municipal agency
15 or institution; or
16 (3) By a public or private school; or
17 (4) By a public clinic operating under the
18 direction of a hospital or federal, State, county,
19 municipal or other public agency or institution.
20 When employed or engaged pursuant to this paragraph (a) a
21 dental hygienist may perform the following procedures and
22 acts:
23 (i) the operative procedure of dental hygiene,
24 consisting of oral prophylactic procedures,
25 (ii) the exposure and processing of X-Ray films of
26 the teeth and surrounding structures,
27 (iii) the application to the surfaces of the teeth
28 or gums of chemical compounds designed to be
29 desensitizing agents or effective agents in the
30 prevention of dental caries or periodontal disease,
31 (iv) all services which may be performed by a

1 dental assistant as specified by rule pursuant to Section
2 17,
3 (v) such other procedures and acts as shall be
4 prescribed by rule or regulation of the Department.
5 (b) Under the general supervision of a dentist in a
6 long-term care facility licensed by the State of Illinois, or
7 a mental health or developmental disability facility operated
8 by the Department of Mental Health and Developmental
9 Disabilities, if the patient is unable to travel to a dental
10 office because of illness or infirmity. The dentist shall
11 personally examine and diagnose the patient and determine
12 which services are necessary to be performed, which shall be
13 contained in a written order to the hygienist. Such order
14 must be implemented within 90 days of its issuance, and an
15 updated medical history and oral inspection must be performed
16 by the hygienist immediately prior to beginning the
17 procedures to ensure that the patient's health has not
18 changed in any manner to warrant a reexamination by the
19 dentist.
20 (b-5) Without fee under the general supervision of a
21 dentist to residents of a senior citizens' retirement home.
22 (c) Without the supervision of a dentist, a dental
23 hygienist may perform dental health education functions and
24 may record case histories and oral conditions observed.
25 The number of dental hygienists practicing in a dental
26 office shall not exceed, at any one time, 4 times the number
27 of dentists practicing in the office at the time.

12 Section 95. No acceleration or delay. Where this Act
13 makes changes in a statute that is represented in this Act by
14 text that is not yet or no longer in effect (for example, a
15 Section represented by multiple versions), the use of that
16 text does not accelerate or delay the taking effect of (i)
17 the changes made by this Act or (ii) provisions derived from
18 any other Public Act.
