1 AMENDMENT TO HOUSE BILL 2589
2 AMENDMENT NO. . Amend House Bill 2589 on page 1,
3 lines 2 and 6, by replacing "Section 1-11" each time it
4 appears with "Sections 1-11 and 3-7"; and
5 on page 2, below line 10, by inserting the following:
6 "(225 ILCS 410/3-7) (from Ch. 111, par. 1703-7)
7 Sec. 3-7. Licensure; renewal; continuing education;
8 military service. The holder of a license issued under this
9 Article III may renew that license during the month preceding
10 the expiration date thereof by paying the required fee,
11 giving such evidence as the Department may prescribe of
12 completing not less than 14 hours of continuing education for
13 a cosmetologist, and 24 hours of continuing education for a
14 cosmetology teacher or cosmetology clinic teacher, within the
15 2 years prior to renewal. The training shall be in subjects
16 approved by the Department as prescribed by rule upon
17 recommendation of the Committee. Each time a licensee renews
18 his or her license, the Department shall inform the licensee
19 about any changes in the law or rules concerning
20 cosmetologists, cosmetology teachers, or cosmetology clinic
21 teachers during the 2 year period before renewal.
22 A license that has been expired for more than 5 years may

1 be restored by payment of the restoration fee and submitting
2 evidence satisfactory to the Department of the current
3 qualifications and fitness of the licensee, which shall
4 include completion of continuing education hours for the
5 period subsequent to expiration.
6 The Department shall establish by rule a means for the
7 verification of completion of the continuing education
8 required by this Section. This verification may be
9 accomplished through audits of records maintained by
10 registrants, by requiring the filing of continuing education
11 certificates with the Department, or by other means
12 established by the Department. The Department may select a
13 qualified organization that has no direct business
14 relationship with a licensee, licensed entity or a subsidiary
15 of a licensed entity under this Act to maintain and verify
16 records relating to continuing education.
17 A license issued under the provisions of this Act that
18 has expired while the holder of the license was engaged (1)
19 in federal service on active duty with the Army of the United
20 States, the United States Navy, the Marine Corps, the Air
21 Force, the Coast Guard, or any Women's Auxiliary thereof, or
22 the State Militia called into the service or training of the
23 United States of America, or (2) in training or education
24 under the supervision of the United States preliminary to
25 induction into the military service, may be reinstated or
26 restored without the payment of any lapsed renewal fees,
27 reinstatement fee, or restoration fee if within 2 years after
28 the termination of this such service, training, or education
29 other than by dishonorable discharge, the holder furnishes
30 the Department with an affidavit to the effect that he or she
31 has been so engaged and that his or her service, training, or
32 education has been so terminated.
33 The Department, in its discretion, may waive enforcement
34 of the continuing education requirement in this Section and

1 shall adopt rules defining the standards and criteria for
2 that waiver under the following circumstances:
3 (a) the licensee resides in a locality where it is
4 demonstrated that the absence of opportunities for such
5 education would interfere with the ability of the
6 licensee to provide service to the public;
7 (b) that to comply with the continuing education
8 requirements would cause a substantial financial hardship
9 on the licensee;
10 (c) that the licensee is serving in the United
11 States Armed Forces; or
12 (d) that the licensee is incapacitated due to
13 illness.
14 The continuing education requirements of this Section for
15 cosmetologists do not apply to a licensee who (i) is at least
16 55 years of age or (ii) has been licensed as a cosmetologist
17 for at least 25 years. The continuing education requirements
18 of this Section for cosmetology teachers and cosmetology
19 clinic teachers do not apply to a licensee who (i) is at
20 least 62 years of age or (ii) has been licensed as a
21 cosmetologist, cosmetology teacher, or cosmetology clinic
22 teacher for at least 30 years and does not regularly work as
23 a cosmetologist, cosmetology teacher, or cosmetology clinic
24 teacher for more than 16 hours per week.

27 on page 2, line 12, after "law", by inserting ", except that
28 the provisions changing Sections 3-7 of the Barber,
29 Cosmetology, Esthetics, and Nail Technology Act of 1985 take
30 effect July 1, 1998".
