1 AN ACT to amend the Illinois Marriage and Dissolution of
2 Marriage Act by changing Section 711.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Marriage and Dissolution of
6 Marriage Act is amended by changing Section 711 as follows:
7 (750 ILCS 5/711) (from Ch. 40, par. 711)
8 Sec. 711. Fees. (a) To reimburse any covered county for
9 the cost of maintaining the child support enforcement program
10 pursuant to Section 710, the court shall order any payor
11 making payments directly to the clerk to pay the clerk a fee
12 at the rate of $3.00 per month for every month the order is
13 in effect. However, any fee collected for any case not
14 included in such program as provided in subsection (a) of
15 Section 710 may be used by the county for any purpose.
16 The fee shall be payable semi-annually, being due with
17 the support payment due on or next immediately following
18 January 1 and July 1. The fee shall be payable in advance as
19 herein provided, except for the initial payment which shall
20 be paid at the time of the initial child support payment to
21 the clerk. The amount of the fee due for the initial period
22 shall be computed from the date the support order first takes
23 effect to the next January 1 or July 1, whichever occurs
24 first.
25 Unless paid in cash, the payment of the fee shall be by a
26 separate instrument from the support payment and shall be
27 made to the order of the clerk.
28 (b) All money monies collected in fees by the clerk and
29 all money monies received by him upon assessment under
30 Section 710 for reimbursement for the costs of enforcement
31 shall be held in a special fund, the contents of which the

1 clerk shall pay over to the county treasury every month or at
2 such other period as the treasurer shall determine.
