1 AMENDMENT TO HOUSE BILL 2827
2 AMENDMENT NO. . Amend House Bill 2827 by replacing
3 the title with the following:
4 "AN ACT to amend the Election Code by changing Sections
5 1-6, 13-10, 13-11, and 17-30."; and
6 by replacing lines 5 and 6 on page 1 with the following:
7 "Section 5. The Election Code is amended by changing
8 Sections 1-6, 13-10, 13-11, and 17-30 as follows:"; and
9 on page 2 by inserting immediately below line 10 the
10 following:
11 (10 ILCS 5/13-10) (from Ch. 46, par. 13-10)
12 Sec. 13-10. The compensation of the judges of all
13 primaries and all elections, except judges supervising
14 absentee ballots as provided in Section 19-12.2 of this Act,
15 in counties of less than 600,000 inhabitants shall be fixed
16 by the respective county boards or boards of election
17 commissioners in all counties and municipalities, but in no
18 case shall such compensation be less than $35 nor more than
19 $75 per day. The compensation of judges of all primaries and
20 all elections not under the jurisdiction of the county clerk,

1 except judges supervising absentee balloting as provided in
2 Section 19-12.2 of this Act, in counties having a population
3 of 2,000,000 or more shall be not less than $60 nor more than
4 $75 per day. The compensation of judges of all primaries and
5 all elections under the jurisdiction of the county clerk,
6 except judges supervising absentee balloting as provided in
7 Section 19-12.2 of this Act, in counties having a population
8 of 2,000,000 or more shall be not less than $60 nor more than
9 $75 per day. The compensation of judges of all primaries and
10 all elections, except judges supervising absentee ballots as
11 provided in Section 19-12.2 of this Act, in counties having a
12 population of at least 600,000 but less than 2,000,000
13 inhabitants shall be not less than $45 nor more than $75 per
14 day as fixed by the county board of election commissioners of
15 each such county. In addition to their per day compensation
16 and notwithstanding the limitations thereon stated herein,
17 the judges of election, in all counties with a population of
18 less than 600,000, shall be paid $3 each for each 100 voters
19 or portion thereof, in excess of 200 voters voting for
20 candidates in the election district or precinct wherein the
21 judge is serving, whether a primary or an election is being
22 held. However, no such extra compensation shall be paid to
23 the judges of election in any precinct in which no paper
24 ballots are counted by such judges of election. The 2 judges
25 of election in counties having a population of less than
26 600,000 who deliver the returns to the county clerk shall
27 each be allowed and paid a sum to be determined by the
28 election authority for such services and an additional sum
29 per mile to be determined by the election authority for every
30 mile necessarily travelled in going to and returning from the
31 office or place to which they deliver the returns. The
32 compensation for mileage shall be consistent with current
33 rates paid for mileage to employees of the county.
34 However, all judges who have been certified by the County

1 Clerk or Board of Election Commissioners as having
2 satisfactorily completed, within the 2 years preceding the
3 day of election, the training course for judges of election,
4 as provided in Sections 13-2.1, 13-2.2 and 14-4.1 of this
5 Act, shall receive additional compensation of not less than
6 $10 nor more than $25 per day in counties of less than
7 600,000 inhabitants, the additional compensation of not less
8 than $10 nor more than $25 per day in counties having a
9 population of at least 600,000 but less than 2,000,000
10 inhabitants as fixed by the county board of election
11 commissioners of each such county, and additional
12 compensation of not less than $20 nor more than $25 per day
13 in counties having a population of 2,000,000 or more for
14 primaries and elections not under the jurisdiction of the
15 county clerk, and additional compensation of not less than
16 $20 nor more than $25 per day in counties having a population
17 of 2,000,000 or more for primaries and elections under the
18 jurisdiction of the county clerk.
19 In precincts in which there are tally judges, the
20 compensation of the tally judges shall be 2/3 of that of the
21 judges of election and each holdover judge shall be paid the
22 compensation of a judge of election plus that of a tally
23 judge.
24 Beginning on the effective date of this amendatory Act of
25 1998, the portion of an election judge's daily compensation
26 reimbursed by the State Board of Elections is increased by
27 $15. The increase provided by this amendatory Act of 1998
28 must be used to increase each judge's compensation and may
29 not be used by the county to reduce its portion of a judge's
30 compensation.

33 Sec. 13-11. It shall be the duty of the county clerk, on

1 the receipt of the election returns of any general or special
2 election, to make out his certificate, stating the
3 compensation to which the judges of each election may be
4 entitled for their services, and lay the same before the
5 county board at its next session; and the board shall order
6 the compensation aforesaid to be paid out of the county
7 treasury. The State Board of Elections shall reimburse such
8 county in the amount of the increase in compensation provided
9 in Public Acts 81-850 and 81-1149 and by this amendatory Act
10 of 1998.

13 Sec. 17-30. Except as provided herein, each county shall
14 provide for and pay the costs and expenses of all elections
15 within the county other than within the jurisdiction of a
16 municipal Board of Election Commissioners, as well as the
17 costs expended within the jurisdiction of a municipal Board
18 of Election Commissioners for the registration and canvassing
19 of voters in even-numbered years. Each municipality with the
20 first Board of Election Commissioners established within a
21 county shall provide for and pay the costs and expenses of
22 all elections within the jurisdiction of the Board of
23 Election Commissioners. The State shall reimburse each county
24 and municipality in the amount of the increase in
25 compensation provided in Public Acts 81-850 and 81-1149 and
26 by this amendatory Act of 1998.
27 For each emergency referendum and each special election
28 not conducted at the time of a regular election, each county
29 and municipality responsible for paying for the costs and
30 expenses shall directly pay for or be reimbursed by every
31 other political subdivision for which officers or public
32 questions are on the ballot within the jurisdiction of the
33 election authority of such county or municipality except such

1 costs and expenses as are required to be reimbursed by the
2 State. For each primary election for the nomination of
3 municipal officers held in a municipality with a population
4 of 5000 or less in accordance with Article 7, the county in
5 which such municipality is located shall be reimbursed by the
6 municipality for all costs and expenses attributable to such
7 primary election, except for those costs and expenses
8 required to be reimbursed by the State. Each such political
9 subdivision shall provide for and shall promptly pay such
10 reimbursement of the total costs and expenses of that
11 election attributable to its offices or propositions as the
12 case may be, not including such costs and expenses as are
13 required to be reimbursed by the State.
