1 AN ACT to amend the Road Worker Safety Act by changing
2 Section 2.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Road Worker Safety Act is amended by
6 changing Section 2 as follows:

9 unconstitutional)
10 Sec. 2. At all times during which men are working where
11 one-way traffic is utilized, the contractor or his authorized
12 agent in charge of such construction will be required to
13 furnish no fewer than 2 two flagmen, one at each end of the
14 portion of highway or bridge on which only one-way traffic is
15 permitted, and at least 100 feet away from the nearest point
16 of the highway or bridge on which only one-way traffic is
17 safe and permitted. The flagmen shall be equipped with safe,
18 suitable, and proper signal devices as prescribed in the
19 Manual on Uniform Traffic Control Devices for Streets and
20 Highways published by the Department of Transportation, and
21 shall so use such devices as to inform approaching motorists
22 to stop or proceed. In addition, safe, suitable, and proper
23 signals and signs as prescribed in the Manual shall be so
24 placed as to warn approaching persons of the existence of any
25 portion of highway or bridge upon which only one-way traffic
26 is safe and permitted. At bridge construction or bridge
27 repair sites, where one-way traffic is utilized, traffic
28 control signals conforming to the Manual may be installed and
29 operated in lieu of, or in addition to, flagmen. Whenever
30 the Department of Transportation or local authorities
31 determine that a bridge or highway construction site requires

1 the closing of a road to through traffic, the contract
2 documents relating to such construction may specify alternate
3 procedures for flagging and controlling traffic, when such
4 procedures have been approved by the Department. When
5 alternate procedures are not included, traffic control and
6 flagging will be as prescribed in the first paragraph of this
7 Section.
