Amends the Consumer Fraud and Deceptive Business
Practices Act. Provides that an Internet service provider
must give each of its customers in this State a
pre-addressed, postage-paid postcard that the customer may
use to cancel service by U.S. Postal Service mail. Provides
that an Internet service provider who violates any of these
provisions commits an unlawful practice within the meaning of
the Act.

1 AN ACT to amend the Consumer Fraud and Deceptive Business
2 Practices Act by adding Section 2II.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Consumer Fraud and Deceptive Business
6 Practices Act is amended by adding Section 2II as follows:

8 Sec. 2II. Internet service providers. An Internet
9 service provider must give each of its customers in this
10 State a pre-addressed, postage-paid postcard that the
11 customer may use to cancel service by U.S. Postal Service
12 mail. The Internet service provider must provide the
13 postcard to the customer within 10 days after the account is
14 opened (or, in the case of an existing customer, within 30
15 days after the effective date of this amendatory Act of
16 1998). An Internet service provider must cancel the
17 customer's account immediately upon receiving the postcard.
18 An Internet service provider who violates any provision of
19 this Section commits an unlawful practice within the meaning
20 of this Act.
21 As used in this Section, "Internet service provider"
22 means a person (regardless of whether the person is located
23 within or outside of Illinois) who provides access
24 (regardless of whether the access is through an online
25 service that provides other services that are not part of the
26 Internet) to customers in this State on an ongoing basis to
27 Internet electronic mail, the World Wide Web, Internet file
28 transfers, or any other information or data that may be sent
29 or received through the Internet.
