Amends the Downstate Police Article of the Pension Code.
Provides that nonduty disability benefits are not available
to a police officer who first becomes a member of the fund on
or after the effective date of this amendatory Act of 1998,
until the officer has at least 7 years of creditable service
in the fund.

1 AN ACT to amend the Illinois Pension Code by changing
2 Section 3-114.2.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Pension Code is amended by
6 changing Section 3-114.2 as follows:

8 Sec. 3-114.2. Disability pension - Not on duty.
9 (a) Subject to the limitation in subsection (d), a
10 police officer who becomes disabled as a result of any cause
11 other than the performance of an act of duty, and who is
12 found to be physically or mentally disabled so as to render
13 necessary his or her suspension or retirement from police
14 service in the police department, shall be entitled to a
15 disability pension of 50% of the salary attached to the
16 officer's rank on the police force at the date of suspension
17 of duty or retirement.
18 (b) If a police officer on disability pension dies while
19 still disabled, the disability pension shall continue to be
20 paid to the officer's survivors in the sequence provided in
21 Section 3-112.
22 (c) From and after July 1, 1987, any pension payable
23 under this Section shall be at least $400 per month, without
24 regard to the fact that the disability or death of the police
25 officer occurred prior to that date.
26 (d) The benefits provided under this Section are not
27 available to a police officer who first becomes a member of
28 the fund on or after the effective date of this amendatory
29 Act of 1998, until the officer has at least 7 years of
30 creditable service in the fund.
