Amends the Metropolitan Water Reclamation District Act.
Provides that no reservoir or addition to a reservoir shall
be used for the storage of water from the T.A.R.P. Deep
Tunnel System unless certain conditions are met. Provides
that no low solids lagoons, high solids lagoons, treatment
process areas, or storage areas shall be located in certain
described areas. Effective immediately.

1 AN ACT to amend the Metropolitan Water Reclamation
2 District Act by adding Sections 65.1, 65.2, and 65.3.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Metropolitan Water Reclamation District
6 Act is amended by adding Sections 65.1, 65.2, and 65.3 as
7 follows:

9 Sec. 65.1. Reservoir, T.A.R.P. Deep Tunnel System. No
10 reservoir or addition to a reservoir used for the storage of
11 water from the T.A.R.P. Deep Tunnel System operating in
12 conjunction with the Stickney Water Reclamation Plant shall
13 be constructed or operated without (i) the coordination of
14 the Army Corps of Engineers and (ii) the procurement of a
15 minimum of 75% federal funding.

17 Sec. 65.2. Lagoons; Cook County. No low solids lagoon,
18 high solids lagoon, and their rail transportation system
19 shall be located in the area southwest of the present most
20 westerly high solids lagoon described as follows:
21 Said southwest area lies in Cook County between the Des
22 Plaines River on the north and the Sanitary and Ship
23 Canal on the south, and is bordered on the east by a line
24 which is parallel to and 11,600 feet to the southwest of
25 the Indiana Harbor Belt Railroad, said 11,600 feet
26 measured parallel to the Sanitary and Ship Canal. The
27 area from this line, which borders the most easterly
28 drying bed, to the most western edge of the most westerly
29 drying bed which also includes the tank farm, cannot be
30 converted to a reservoir, modified, or converted to any

1 other treatment process or storage area for any product
2 of the Metropolitan Water Reclamation District. Said
3 western edge lies in Cook County between the Des Plaines
4 River on the north and the Sanitary and Ship Canal on the
5 south, and is located perpendicular to the Sanitary and
6 Ship Canal and 5,300 feet to the southwest of the center
7 line of La Grange Road at the approximate midpoint
8 between the Des Plaines River and the Sanitary and Ship
9 Canal and is measured parallel to the Sanitary and Ship
10 Canal.

12 Sec. 65.3. Treatment process area; Cook County. No
13 treatment process or storage area for any product of the
14 District shall be located in the tank farm area or west of
15 the western edge of the most westerly drying bed described as
16 follows:
17 Said western edge lies in Cook County between the Des
18 Plaines River on the north and the Sanitary and Ship
19 Canal on the south, and is located perpendicular to the
20 Sanitary and Ship Canal and 5,300 feet to the southwest
21 of the center line of La Grange Road at the approximate
22 midpoint between the Des Plaines River and the Sanitary
23 and Ship Canal and is measured parallel to the Sanitary
24 and Ship Canal.
25 Section 99. Effective date. This Act takes effect upon
26 becoming law.
