1 AMENDMENT TO HOUSE BILL 3399
2 AMENDMENT NO. . Amend House Bill 3399, AS AMENDED,
3 as follows:
4 by replacing the title with the following:
5 "AN ACT to amend the Family Practice Residency Act by
6 changing Section 10."; and
7 by replacing everything after the enacting clause with the
8 following:
9 "Section 5. The Family Practice Residency Act is amended
10 by changing Section 10 as follows:
11 (110 ILCS 935/10) (from Ch. 144, par. 1460)
12 Sec. 10. Scholarship recipients who fail to fulfill the
13 obligation described in subsection (d) of Section 3.07 of
14 this Act shall pay to the Department a sum equal to 3 times
15 the amount of the annual scholarship grant for each year the
16 recipient fails to fulfill such obligation. A scholarship
17 recipient who fails to fulfill the obligation described in
18 subsection (d) of Section 3.07 shall have 30 days from the
19 date on which that failure begins in which to enter into a
20 contract with the Department that sets forth the manner in
21 which that sum is required to be paid. If the contract is

1 not entered into within that 30 day period or if the contract
2 is entered into but the required payments are not made in the
3 amounts and at the times provided in the contract, the
4 scholarship recipient also shall be required to pay to the
5 Department interest at the rate of 9% per annum on the amount
6 of that sum remaining due and unpaid.
7 Until January 1, 2000 the Director may waive payment of
8 the sum otherwise due under this Section in the case of a
9 scholarship recipient who (i) practices psychiatry full-time
10 in a Designated Shortage Area one year for each year he or
11 she was a scholarship recipient, but does not practice as a
12 primary care physician, and (ii) has met or meets all other
13 qualifications for receipt of the scholarship as provided in
14 this Act.
15 The amounts paid to the Department under this Section
16 shall be deposited into the Community Health Center Care Fund
17 and shall be used by the Department to improve access to
18 primary health care services as authorized by Section
19 55.53(a) of the Civil Administrative Code of Illinois.
20 The Department may transfer to the Illinois Development
21 Finance Authority, into an account outside the State
22 treasury, moneys in the Community Health Center Care Fund as
23 needed, but not to exceed an amount established, by rule, by
24 the Department to establish a reserve or credit enhancement
25 escrow account to support a financing program or a loan or
26 equipment leasing program to provide moneys to support the
27 purposes of Section 55.53(a) of the Civil Administrative Code
28 of Illinois. The disposition of moneys at the conclusion of
29 any financing program under this Section shall be determined
30 by an interagency agreement.

32 Section 99. Effective date. This Act takes effect upon
33 becoming law.".
