Act. Provides that a person who without good cause defaults
on an order for child support issued by an Illinois court
for a period of 2 months or longer is guilty of a Class A
misdemeanor. Provides for community service to be performed
by an offender.

1 AN ACT to amend the Illinois Marriage and Dissolution of
2 Marriage Act by adding Section 714.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Marriage and Dissolution of
6 Marriage Act is amended by adding Section 714 as follows:

8 Sec. 714. Default on support; penalties.
9 (a) Beginning on the effective date of this amendatory
10 Act of 1998, a person who without good cause defaults on an
11 order for child support issued by an Illinois court for a
12 period of 2 months or longer is guilty of a Class A
13 misdemeanor.
14 (b) In addition to any other sentence that may be
15 imposed, a court shall order any person convicted of default
16 on child support under subsection (a) to perform community
17 service for not less than 30 and not more than 120 hours, if
18 community service is available in the jurisdiction and is
19 funded and approved by the county board of the county where
20 the offense was committed. In addition, whenever any person
21 is placed on supervision for an alleged offense under this
22 Section, the supervision shall be conditioned upon the
23 performance of the community service.
24 This subsection does not apply when the court imposes a
25 sentence of incarceration.
26 (c) This Section applies to any judicial or
27 administrative order for child support issued under this
28 Act, the Illinois Public Aid Code, the Non-Support of Spouse
29 and Children Act, the Revised Uniform Reciprocal Enforcement
30 of Support Act, or the Illinois Parentage Act of 1984.
