1 AN ACT to amend the Dance Studio Act by changing Section
2 7.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Dance Studio Act is amended by changing
6 Section 7 as follows:
7 (815 ILCS 610/7) (from Ch. 29, par. 50-7)
8 Sec. 7. Prohibited contract provisions. (a) (Blank). No
9 contract for dance studio services shall require payment of a
10 total amount in excess of $2500, and every such contract must
11 so provide in writing.
12 (b) No contract for dance studio services shall require
13 payments or financing over a period in excess of one year
14 from the date the contract is entered into, nor shall the
15 term of any such contract be measured by the life of the
16 customer. The services to be rendered under the contract may
17 not extend over a period of more than one year from the date
18 the parties enter into the contract. Every contract for
19 dance studio services shall include these prohibitions in
20 writing.
21 (c) No contract for dance studio services shall require
22 or entail the execution of any note by the customer which,
23 when separately negotiated, will cut off as to third parties
24 any right of action or defense which the customer may have
25 against the dance studio. No right of action or defense
26 arising out of a contract for dance studio services which the
27 customer has against the studio shall be cut off by
28 assignment of the contract whether or not the assignee
29 acquires the contract in good faith and for value. Such an
30 assignee is not a holder in due course.
