technical change in a Section concerning landscape waste.

1 AN ACT to amend the Environmental Protection Act by
2 changing Section 22.22.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Environmental Protection Act is amended
6 by changing Section 22.22 as follows:
7 (415 ILCS 5/22.22) (from Ch. 111 1/2, par. 1022.22)
8 Sec. 22.22. Landscape waste.
9 (a) Beginning July 1, 1990, no person may knowingly mix
10 landscape waste that is intended for collection or for
11 disposal at a landfill with any other municipal waste.
12 (b) Beginning July 1, 1990, no person may knowingly put
13 landscape waste into a container intended for collection or
14 disposal at a landfill, unless the such container is
15 biodegradable.
16 (c) Beginning July 1, 1990, no owner or operator of a
17 sanitary landfill shall accept landscape waste for final
18 disposal, except that landscape waste separated from
19 municipal waste may be accepted by a sanitary landfill if (1)
20 the landfill provides and maintains for that purpose separate
21 landscape waste composting facilities and composts all
22 landscape waste, and (2) the composted waste is utilized, by
23 the operators of the landfill or by any other person, as part
24 of the final vegetative cover for the landfill or for such
25 other uses as soil conditioning material, or the landfill has
26 received an Agency permit to use source separated and
27 processed landscape waste as an alternative daily cover and
28 the landscape waste is processed at a site, other than the
29 sanitary landfill, that has received an Agency permit before
30 the effective date of this amendatory Act of 1997 to process
31 landscape waste. For purposes of this Section, (i) "source

1 separated" means divided into its component parts at the
2 point of generation and collected separately from other solid
3 waste and (ii) "processed" means shredded by mechanical means
4 to reduce the landscape waste to a uniform consistency.
5 (d) The requirements of this Section shall not apply (i)
6 to landscape waste collected as part of a municipal street
7 sweeping operation where the intent is to provide street
8 sweeping service rather than leaf collection, nor (ii) to
9 landscape waste collected by bar screens or grates in a
10 sewage treatment system.
