1 AN ACT to amend the Toll Highway Act by changing Section
2 2.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Toll Highway Act is amended by changing
6 Section 2 as follows:
7 (605 ILCS 10/2) (from Ch. 121, par. 100-2)
8 Sec. 2. The following words and terms As used in this Act
9 shall have the following meanings:
10 (a) The word "Authority" shall mean The Illinois State
11 Toll Highway Authority.
12 (b) The word "person," shall mean any individual, firm,
13 association, partnership, corporation, trustee or legal
14 representative.
15 (c) The word "owner," shall include all individuals,
16 copartnerships, firms, associations, corporations, trustees
17 or legal representatives, and others having any title or
18 interest in any property, rights or easements authorized to
19 be acquired by this Act.
20 (d) The words "toll highway" or "toll highways," shall
21 mean such highways as are so designed and constructed, in the
22 best professional judgment of the engineering staff
23 responsible, as to accomplish the purposes of this Act.
24 (e) The word "toll" or "tolls" shall mean the
25 compensation to be paid to The Illinois State Toll Highway
26 Authority for the privilege of using any toll highway, or
27 portions or parts thereof, by vehicular or other traffic.
28 (f) The word "cost" as applied to a toll highway shall
29 embrace the cost of construction, including bridges over or
30 under existing highways and railroads, the cost of
31 acquisition of all land, rights of way, property, rights,

1 easements and interests acquired by the Authority for such
2 construction, the cost of demolishing or removing any
3 buildings or structures on land so acquired, including the
4 cost of acquiring any lands to which such buildings or
5 structures may be moved, the cost of diverting highways,
6 interchange of highways, access to roads to private property,
7 including the cost of lands or easements therefor, the cost
8 of all machinery and equipment, financing charges, interest
9 prior to and during construction, and for one or more years
10 after completion of construction, cost of traffic estimates
11 and of engineering and legal expenses, plans, specifications,
12 surveys, estimates of cost and revenues, other expenses
13 necessary or incident to determining the feasibility or
14 practicability of constructing any such toll highway,
15 administrative expenses and such other expense as may be
16 necessary or incident to the construction of the toll
17 highway, the financing of such construction and the placing
18 of the highway in operation.
