New Act
110 ILCS 205/10 from Ch. 144, par. 190
Creates the Tuition Increase Moratorium Act and amends
the Board of Higher Education Act. Prohibits the governing
boards of all public universities of the State from
increasing or authorizing an increase in the rate of
undergraduate or graduate tuition charged at any campus for
any period of any academic year that begins on or after the
amendatory Act's effective date and that ends on or before
September 1, 2003. Effective immediately.

1 AN ACT in relation to higher education.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the
5 Tuition Increase Moratorium Act.
6 Section 5. Definition. As used in this Act, "public
7 institution of higher education" has the meaning ascribed to
8 it in Section 1 of the Board of Higher Education Act, except
9 it does not include any public community college of this
10 State.
11 Section 10. Suspension of tuition increases.
12 Notwithstanding any other law of this State, the governing
13 board of a public institution of higher education shall not
14 increase or authorize an increase in the rate of
15 undergraduate or graduate tuition charged at any campus of a
16 university under its jurisdiction for any period of any
17 academic year that begins on or after the effective date of
18 this Act and that ends on or before September 1, 2003.
19 Section 75. The Board of Higher Education Act is amended
20 by changing Section 10 as follows:

22 Sec. 10. The Board of Trustees of the University of
23 Illinois, the Board of Trustees of Southern Illinois
24 University, the Board of Trustees of Chicago State
25 University, the Board of Trustees of Eastern Illinois
26 University, the Board of Trustees of Governors State
27 University, the Board of Trustees of Illinois State
28 University, the Board of Trustees of Northeastern Illinois

1 University, the Board of Trustees of Northern Illinois
2 University, the Board of Trustees of Western Illinois
3 University, and the Illinois Community College Board shall
4 retain all the powers and duties heretofore given and
5 conferred upon them by statute, except insofar as they are
6 limited by the powers and duties delegated to the Board of
7 Higher Education by this Act.
8 Each of the individual state universities is subject to
9 the Tuition Increase Moratorium Act. Nothing, however, in
10 this Act shall be construed to prevent individual state
11 universities and colleges from establishing higher minimum
12 admission requirements and higher minimum admission
13 requirements may be established for out-of-state students
14 than for Illinois residents.

16 Section 99. Effective date. This Act takes effect upon
17 becoming law.
